Ces principes viennent, dans un certain nombre de cas, se heurter à des obligations particulières qui naissent du contrat de travail et qui, parfois, peuvent perdurer au-delà de celui-ci. Il est en effet traditionnellement admis que le principe d'exécution de bonne foi des conventions interdit à un travailleur d'exercer une activité concurrentielle, fût-elle loyale, à l'encontre de son employeur durant l'exécution du contrat. Par ailleurs, l'article 17,3°de la loi du 3 juillet 1978 interdit la concurrence déloyale tant durant l'exécution qu'après la cessation avec la particularité que le travailleur, ou l'ancien travailleur, dispose souvent d'informations particulières qui lui permettraient d'exercer plus facilement une telle concurrence. C'est cette tension entre ces droits antagonistes qu'a voulu examiner la Conférence du Jeune Barreau de Charleroi lors d'un colloque dont cet ouvrage reprend les actes. Après une réflexion générale sur la concurrence du salarié à son employeur et à la lumière de l'obligation de bonne foi, les auteurs font le point sur les régimes des clauses de non-concurrence, que ce soit pour les employés, les ouvriers, les représentants de commerce ou la clause dérogatoire de non-concurrence. Ils étudient également la validité de la clause d'exclusivité et des clauses anti-débauchage. La concurrence déloyale du travailleur est analysée distinctement. L'approche voulue sort du strict cadre du droit social, puisqu'elle aborde la problématique de la clause de non-concurrence en droit commun et la clause de non-concurrence post-contractuelle qui vient d'être modifiée par le législateur, intégrant, au passage, son sort en sécurité sociale

Book excerpt: The International Labour Organization was created in 1919, as part of the Treaty of Versailles that ended the First World War, to reflect the belief that universal and lasting peace can be accomplished only if it is based on social justice. As the oldest organisation in the UN system, approaching its 100th anniversary in 2019, the ILO faces unprecedented strains and challenges. Since before the financial crisis, the global economy has tested the limits of a regulatory regime which was conceived in 1919. The organisation's founders only entrusted it with balancing social progress with the constraints of an interconnected open economy, but gambled almost entirely on tools of persuasion to ensure that this would happen. Whether that gamble is still capable of paying-off is the subject of this book, by a former ILO insider with an unrivalled knowledge of its work. The book forms part of a broader inquiry into the relevance of founding institutional principles to today's context, and strives to show that the bet made on persuasion may yet pay off. In part, the text argues that there may be little alternative anyway, showing that the pathways to more binding solutions are fraught with difficulty. It also shows the ILO's considerable future potential for promoting effective, universal regulations by extending its tools of persuasion in as yet insufficiently explored directions.
