L’entrata in vigore del Codice della crisi detta una nuova disciplina del sovraindebitamento, che nonostante elementi di continuità nei modelli presenti nella l. n. 3/2012, contiene significativi profili di novità, tali da condurre (anche) a una maggior diffusione e applicazione delle procedure di sovraindebitamento, nonché ad una maggiore attenzione, nell'aggiornamento, da parte di tutte le professionalità operanti in ambito concorsuale. L’inserimento in un’opera di codificazione unitaria comporta, inoltre, importanti richiami interni tra i vari istituti che impongono il recupero, ad es., nell’analisi della disciplina del concordato minore, dell’imponente dibattito che si sta registrando in relazione al concordato preventivo, con particolare riferimento a quello con continuità aziendale, come una progressiva estensione – ai soggetti di natura imprenditoriale rientranti nell’ambito di applicazione dell’art. 2 lett. c) CCII – di istituti concepiti per le c.d. imprese maggiori (come la composizione negoziata, il concordato semplificato, ecc. ...). Ciò rende necessaria anche un’analisi in una prospettiva economico-aziendale sino ad ora assente o, comunque, non contenuta all’interno di lavori che si occupassero della disciplina giuridica del sovraindebitamento.
