La certificazione può svolgere un ruolo focale nella declinazione di questa trasformazione, in quanto strumento di promozione della certezza del diritto del lavoro e dell’autodeterminazione, in una chiave di lettura che muove della valorizzazione del rimedio della volontà individuale assistita. L’opera si propone di ragionare in maniera sistematica del fenomeno certificatorio, tracciandone un profilo marcatamente poliedrico, disegnato a partire dalla fiducia ad ampio spettro che il legislatore ha dimostrato nella concretizzazione dell’idea originaria di Marco Biagi. Sebbene oggetto di importanti ritrosie ideologiche, alla certificazione il legislatore ha fatto puntualmente ricorso nelle riforme degli ultimi vent’anni e non soltanto per affidarle il discernimento di dilemmi qualificatori di non poco momento. Nonostante l’evidente polimorfismo, il congegno certificatorio non ha, tuttavia, ancora espresso tutte le sue potenzialità, specie con riferimento all’inquadramento come strumento di compliance e legalità, in ambito di responsabilità sociale, salute e sicurezza sul lavoro, liceità dell’esecuzione della prestazione lavorativa, uguaglianza di genere e più in generale, di promozione del lavoro dignitoso.
