Download or read book The Western Codification of Criminal Law written by Aniceto Masferrer and published by Springer. This book was released on 2018-03-09 with total page 427 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume addresses an important historiographical gap by assessing the respective contributions of tradition and foreign influences to the 19th century codification of criminal law. More specifically, it focuses on the extent of French influence – among others – in European and American civil law jurisdictions. In this regard, the book seeks to dispel a number of myths concerning the French model’s actual influence on European and Latin American criminal codes. The impact of the Napoleonic criminal code on other jurisdictions was real, but the scope and extent of its influence were significantly less than has sometimes been claimed. The overemphasis on French influence on other civil law jurisdictions is partly due to a fundamental assumption that modern criminal codes constituted a break with the past. The question as to whether they truly broke with the past or were merely a degree of reform touches on a difficult issue, namely, the dichotomy between tradition and foreign influences in the codification of criminal law. Scholarship has unfairly ignored this important subject, an oversight that this book remedies.

Download or read book New Perspectives in Italian Cultural Studies written by Graziella Parati and published by Fairleigh Dickinson. This book was released on 2012-11-10 with total page 345 pages. Available in PDF, EPUB and Kindle. Book excerpt: Following the more theoretical first installment of New Perspectives in Italian Cultural Studies devoted to Definitions, Theory, and Accented Practices, the second volume of New Perspectives deals with practicing cultural studies by offering articles that are valuable for both scholars of Italian studies and students interested in a cultural studies approach. Divided in four sections, the articles included offer complex approaches to literature, film, the visual arts, and a particular moment in Italian history with which Italians are still coming to terms, fascism. The essays cover about two hundred years of Italian cultures dealing with the construction of national myths, the role of soccer in contemporary debates, the contemporary success of mystery novels, and issues of race and crime in fascist Italy. Contributors look at film through the lens of fashion history and the particular Italian use of dubbing that continues even today. Place and memory are the topics of a number of essays that also allows for an interpretation of Italian culture inAmericans’ imagination. This volume contains a multifaceted representation of Italy and invites additional discussion on the complexity of representing cultures

Download or read book The Defence of Mistake of Law in International Criminal Law written by Antonio Coco and published by Oxford University Press. This book was released on 2022-07-11 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: The adage 'ignorance of the law is no excuse' is significantly inaccurate. Ignorance and mistake of law do, under certain circumstances, exclude responsibility both in national and international criminal law. This monograph updates the existing reviews of law and practice on the topic, aiming to go a step further: it takes the analysis of mistake of law as a starting point for systematic observations about international criminal law in general. First, the volume defines the contours of the defence of mistake of law in general theory of criminal law, distinguishing it from cognate defences and highlighting, most notably, its connection with superior orders. Secondly, it gives an overview of the possible approaches to the defence, offering examples from national law as terms of reference for the subsequent analysis of international criminal law. Thirdly, it surveys the relevant law and practice of international criminal tribunals, with a focus on the International Criminal Court, and it contemplates offences for which a defence of mistake of law may potentially succeed. Finally, the author tries to interpret what the rules on mistake of law applicable before international criminal tribunals imply about the purpose of punishing individuals and to the legitimacy of such punishment. Whilst the discourse on international criminal law is more and more concerned with global politics, The Defence of Mistake of Law in International Criminal Law brings back the focus on the appropriateness of imposing a guilty verdict on the individual defendant, a human being constituting the basic unit of each society.
Download or read book Organized Crime 2 volumes written by Frank Shanty and published by Bloomsbury Publishing USA. This book was released on 2007-09-24 with total page 849 pages. Available in PDF, EPUB and Kindle. Book excerpt: This fascinating work is a two-volume guide to the shadow world, the critical issues, and the global reach of organized crime. Despite its impact on international security and the world economy, organized crime is an unusual topic for a reference book. Difficult to research, the high-profit, high-risk subculture of drug lords, diamond smugglers, and sex slavers is rarely investigated by scholars. Organized Crime: An International Encyclopedia ventures behind the scenes into this hazardous territory. In the first volume, expert contributors offer a global perspective on issues such as weapons and arms trafficking, high-tech and cyber crimes, the future of organized crime, and the connection between organized crime and armed conflicts. The second volume consists entirely of primary documents, national and international laws, and treaties that reflect the international community's many attempts—largely ineffective—to combat organized crime. Together the two volumes provide students and general readers with a road map to a shadow world with far-reaching impact on the world we know.
