Book excerpt: Cet ouvrage, à contre-courant du pragmatisme ambiant, vise à rassembler des réflexions centrées sur la problématique de base de l’arbitrage et à en rappeler les enjeux théoriques. Bien que riche d’une longue histoire, l’arbitrage persiste à soulever dans son acception juridique de délicates interrogations, notamment quant à sa définition par rapport aux autres modes alternatifs de règlement des différends. Il a connu au XXe siècle un essor prodigieux à la faveur d’un exceptionnel développement des relations économiques et la recherche d’ordre sociologique permet en partie de mesurer l’ampleur du phénomène. Mais c’est surtout à une réflexion d’ordre philosophique qu’il convient de procéder afin de s’interroger sur le sens de l’évolution de la matière et ses spécificités. Ainsi, dans sa vocation et son fonctionnement, l’arbitrage exprime en tant que véritable justice les valeurs de l’humanisme, mais il manifeste aujourd’hui à titre égal son caractère mécaniste sous la pression de la technique et de l’économie. L’ère de lutte pour la survie dans laquelle l’arbitrage a dû affirmer sa légitimité et sa nécessité face au monde judiciaire et aux pouvoirs publics, a priori peu favorables à l’expansion d’une justice privée, tout en cherchant à s’évader du cadre jugé trop étroit des ordres juridiques étatiques, est désormais révolue en s’universalisant, l’arbitrage s’est banalisé, affadi, voire même altéré en s’éloignant de ses origines ; devenu un rouage clé des institutions de la société marchande, il connaît aujourd’hui d’inquiétantes dérives : judiciarisation, bureaucratisation, relativisation de l’éthique et course à un véritable « march頻 de l’arbitrage. Ces réflexions s’efforcent de mettre en lumière ces tendances en restituant à l’arbitrage ses dimensions philosophique et théorique, trop souvent occultées.

Today, transnational firms and states settle their most important commercial and investment disputes not in courts, but in arbitral centres, a tightly networked set of organizations that compete with one another for docket, resources, and influence. In this book, Alec Stone Sweet and Florian Grisel show that international arbitration has undergone a self-sustaining process of institutional evolution that has steadily enhanced arbitral authority. This judicialization process was sustained by the explosion of trade and investment, which generated a steady stream of high stakes disputes, and the efforts of elite arbitrators and the major centres to construct arbitration as a viable substitute for litigation in domestic courts. For their part, state officials (as legislators and treaty makers), and national judges (as enforcers of arbitral awards), have not just adapted to the expansion of arbitration; they have heavily invested in it, extending the arbitral order's reach and effectiveness. Arbitration's very success has, nonetheless, raised serious questions about its legitimacy as a mode of transnational governance. The book provides a clear causal theory of judicialization, original data collection and analysis, and a broad, relatively non-technical overview of the evolution of the arbitral order. Each chapter compares international commercial and investor-state arbitration, across clearly specified measures of judicialization and governance. Topics include: the evolution of procedures; the development of precedent and the demand for appeal; balancing in the public interest; legitimacy debates and proposals for systemic reform. This book is a timely assessment of how arbitration has risen to become a key component of international economic law and why its future is far from settled.
