Available in PDF, EPUB and Kindle. Book excerpt: Introduction : Les pandémies frappent l'humanité depuis des siècles. Les textes anciens relatent les épidémies de peste, de choléra et de variole. Les temps modernes ont quant à eux, été marqué par plusieurs pandémies grippales. Les coronavirus ont été responsables d'une pandémie en 2003 (SARS-CoV) et en 2012 (MERS-CoV). Ces deux épisodes n'ont pas eu la même gravité. Il en est de même concernant la dernière pandémie grippale H1N1. Le SARS-CoV-2 nous a rappelé l'importance du risque pandémique. Notre pays, la France, a été particulièrement touché. La littérature scientifique abonde sur les caractéristiques et la compréhension de ces pandémies. Néanmoins, le déroulement, l'organisation et l'impact sur les structures hospitalières à un niveau plus local restent peu décrits, ou peu diffusés. C'est pourtant aussi de ce type de travaux que le ressenti et la gravité d'une crise peu s'apprécier concrètement. Après une revue de littérature des précédentes pandémies et un rappel du contexte international et national, nous avons réalisé une synthèse de la gestion et du vécu de cette première vague de COVID19 au CHRU de Strasbourg, et plus particulièrement aux Urgences, au service des maladies infectieuses et tropicales (SMIT), et en réanimation. Méthode : Nous avons interviewé plusieurs médecins dans chacun des services cités cidessus pour recueillir leur témoignage. Nous avons utilisé tous les documents officiels en rapport avec cette période (protocoles, compte-rendu, mails, recommandations). Nous avons analysé les flux de malades aux Urgences en se basant sur les recueils informatiques. Résultats : Nous avons décrit comment les différents services ont fait face à cette nouvelle pathologie et comment ils ont été impactés par cette crise. Nous avons décrit l'organisation originale et le flux des patients dans les deux services d'Urgences du CHRU de Strasbourg. Conclusion : La pandémie de COVID a montré la capacité d'adaptation et de résilience des personnels hospitaliers qui ont fait face de manière unie et solidaires et ont pu assurer une prise en charge de qualité malgré l'afflux de malades.

After much hesitation, the International Law Commission codified the state of necessity as a circumstance precluding wrongfulness in the field of State responsibility. This study aims to demonstrate that it is a much wider mechanism, essential to international law and strictly connected to its own characteristics. It performs the function of limiting the substantial obligations of States in case of the realization of a fact condition – a situation of necessity – in order to avert an excessive social cost, born out of law implementation. It always works through a balance of conflicting interests. Only when a social cost cannot be avoided, the state of necessity, under the features of a mitigating circumstance, enters the field of secondary obligations relating to international responsibility.

Book excerpt: Section 33 – what is commonly referred to as the notwithstanding clause (NWC) – was written into the Canadian Charter of Rights and Freedoms to allow Parliament and the provinces to provisionally override certain Charter rights. The Notwithstanding Clause and the Canadian Charter examines the NWC from all angles and perspectives, considering who should have the last word on matters of rights and justice – the legislatures or the unelected judiciary – and what balance liberal democracy requires. In the case of Quebec, the use of the clause has been justified as necessary to preserve the province’s culture and promote its identity as a nation. Yet Quebec’s pre-emptive and sweeping invocation of the clause also challenges the scope of judicial review and citizens’ recourse to it, and it tests the assumption that a dialogue between the judiciary and the legislature is always preferable in instances in which the legislative branch decides to suspend the operation of certain Charter rights and freedoms. By virtue of its contested purposes, interpretations, operation, and applications, the NWC represents and, to an extent, defines both the character and the very real vulnerabilities of liberal constitutionalism in Canada. The significance, effects, and legitimacy of the NWC have been vigorously debated within scholarship and among politicians and activists since the patriation of the Canadian Constitution in 1982. In The Notwithstanding Clause and the Canadian Charter leading scholars, jurists, and policy experts elucidate and prescribe reforms to the application of this consequential clause about which so much is written, and around which there is relatively little consensus.
