Elle se présente tout d’abord comme une obligation de contenu variable qui se décline de plusieurs composantes. Cela peut apparaître en analysant les éléments constitutifs du contenu de cette obligation. Il ressort de ces éléments constitutifs des éléments permanents qui consiste en une obligation de renseignement et de mise en garde. Il ressort également des éléments constitutifs des éléments renforçant du contenu de l’obligation d’information qui se forment par une obligation de conseil et par une obligation d’assistance technique. La spécificité du contenu de l’obligation d’information se dégage des éléments accessoires qui se représentent par les modalités de sa mise en œuvre et par les qualités tenant à la forme et au contenu de l’information. La particularité de la notion de l’obligation d’information se dégage ensuite par le caractère relatif de cette obligation qui découle de l’analyse des facteurs affectant le contenu de cette obligation. Ces critères sont tantôt objectifs t tantôt subjectifs. La nature spécifique de la matière informatique a également son influence sur le régime de l’obligation d’information. Cela se confirme par l’insuffisance des règles classiques du droit civil. L’insuffisance de ces règles concerne les conditions et les effets de l’application de la théorie des vices de consentements, l’exigence de bonne foi ou de l’équité ou encore des règles de droit des contrats spéciaux notamment celles concernant l’obligation de délivrance ou de garantie de vices cachés. L’insuffisance des règles de droit commun se confirme également concernant les règles de la responsabilité contractuelle qu’il soit au niveau des difficultés de l’appréciation des conditions de sa mise en œuvre ou de la possibilité de supprimer ou de limiter cette responsabilité. Ladoption d’un régime spécifique est apparue nécessaire afin d’éviter les difficultés d’application des règles de la responsabilité contractuelle. La nature spécifique de cette responsabilité confirme cette tendance. Il s’agit d’une responsabilité de nature unitaire qui intervient en toute hypothèse. Le régime de cette responsabilité peut être envisagé comme une responsabilité professionnelle alourdie ou objective. Cette responsabilité se base tout d’abord sur le fondement de l’infléchissement du droit commun à l’égard des professionnels dans le but de garantir la réparation de tout dommage. Le régime spécifique se base ensuite sur un critère objectif. Les sanctions imposées aux professionnels dans cette matière peuvent consister en la résolution du contrat, la réparation en nature ou par équivalent.

The cases represent a seismic shift in Canadian copyright law, with the Court providing an unequivocal affirmation that copyright exceptions such as fair dealing should be treated as users’ rights, while emphasizing the need for a technology neutral approach to copyright law. The Court’s decisions, which were quickly dubbed the “copyright pentalogy,” included no fees for song previews on services such as iTunes, no additional payment for music included in downloaded video games, and that copying materials for instructional purposes may qualify as fair dealing. The Canadian copyright community soon looked beyond the cases and their litigants and began to debate the larger implications of the decisions. Several issues quickly emerged. This book represents an effort by some of Canada’s leading copyright scholars to begin the process of examining the long-term implications of the copyright pentalogy. The diversity of contributors ensures an equally diverse view on these five cases, contributions are grouped into five parts. Part 1 features three chapters on the standard of review in the courts. Part 2 examines the fair dealing implications of the copyright pentalogy, with five chapters on the evolution of fair dealing and its likely interpretation in the years ahead. Part 3 contains two chapters on technological neutrality, which the Court established as a foundational principle of copyright law.
