L’assurance est une branche économique très réglementée : il y existe un foisonnement législatif et jurisprudentiel. La protection des candidats et preneurs d’assurances, futurs ou actuels assurés, reste une des préoccupations majeures du législateur et des juges. La nature économique de la réglementation de l’assurance entretient un bien collectif entre les différents acteurs présent sur ce marché : la confiance. Le devoir de conseil a pour finalité de maintenir cette confiance : notamment entre les assureurs et les preneurs d’assurance. Ce devoir à la charge des assureurs et de l’ensemble des acteurs proposant des services d’assurance est une notion éminemment subjective, qui est la résultante d’un travail intellectuel mené par la personne qui propose la souscription d’un contrat d’assurance. Le contenu du devoir de conseil est conditionné par les échanges d’informations réalisés entre les parties. Le débiteur du devoir de conseil doit, à partir des informations qu’il récolte sur son prospect, sélectionner les « produits » qui sont susceptibles de répondre à ses demandes et adaptés à sa situation économique réelle. Dans le domaine de l’assurance, l’analyse des obligations d’information et de conseil varie sensiblement selon la qualité des personnes débitrices. En droit des assurances, ces obligations pèsent, en premier lieu, sur l’assureur et les intermédiaires d’assurances. En second lieu, ces obligations sont à la charge d’une multitude de personnes qui proposent la souscription de contrats d’assurances à titre accessoire. En troisième lieu, un acteur majeur de la distribution des services d’assurances est le souscripteur d’assurances collectives. Les assurances collectives sont nées de la pratique, et occupent désormais une place économique prépondérante dans le secteur de l’assurance en France. Les problématiques juridiques soulevées par l’étude des obligations d’information, de mise en garde et de conseil sont différentes selon la nature individuelle ou collective du contrat d’assurance. Dans une présentation d’opérations d’assurances effectuées par un intermédiaire d’assurance, le candidat à l’assurance ou/et l’assuré sont alors créanciers d’obligations d’information lato sensu à la charge de deux personnes distinctes : l’assureur et l’intermédiaire d’assurance. A la différence de ce schéma « classique », les assurances collectives présentent une diversité d’intervenants. Notre étude a pour objectif de traiter les différentes problématiques juridiques afférentes aux obligations d’information, de mise en garde et de conseil dus au preneur individuel d’assurance et au futur, ou d’ores et déjà, adhérent à un contrat d’assurance collective. La présentation de chaque obligation est un préalable à l’étude de sa qualité. Le but avéré de cette recherche est de prendre position sur la cohérence du système informatif au sens large établi en droit du contrat d’assurances. Notre recherche est essentiellement axée sur le droit interne, cependant l’influence des directives européennes sur l’objet de notre étude, ainsi que celle de certains droits étrangers, ne peuvent être éludées et trouveront place au sein de nos développements.

A short introduction sets out the approach used by the Project Group, how the PEICL/DCFR Insurance relate to the overall Draft Common Frame of Reference, the participation of the Project Group in the CoPECL (Common Principles of European Contract Law) Network, as well as the general structure and characteristics of the PEICL/DCFR Insurance. The Project Group has also drafted the PEICL/DCFR Insurance as a model for an Optional Instrument of European Insurance Contract Law.
