Les textes européens, et en particulier la directive sur la distribution d'assurance (DDA), modifient désormais les contours français de la distribution d'assurance. Cette influence se traduit principalement par une amplification des contraintes selon deux aspects. Le premier aspect est le plus novateur en ce qu'il crée une protection globale de la clientèle en amont de l'acte de distribution. Celle-ci se traduit par un arsenal de lutte contre les conflits d'intérêts et des contraintes de gouvernance et de surveillance des produits. Ces règles nouvelles, qui suscitent certaines difficultés d'application, doivent permettre au preneur d'assurance de bénéficier d'un contexte plus favorable lorsqu'il souscrit ou adhère à un contrat d'assurance. Le second aspect concerne la protection du preneur d'assurance telle que connue en France, au niveau individuel. Il s'agit alors d'enrichir les obligations à la charge des professionnels en matière d'information et de conseil. Cette thèse met en perspective des apports de la DDA avec les précédents textes européens et les confronte au droit français préexistant. Elle mesure ce que le droit européen apporte au droit français en matière de distribution d'assurance et présente des clés de compréhension des nouvelles dispositions. Tout en interrogeant l'efficacité des dispositifs, elle envisage quels seront les prochains.

Book excerpt: Le marché européen de l’assurance s’est construit de manière classique à partir des grands principes de liberté d’établissement et de libre prestation de services. À la différence des secteurs de la banque et de la finance, l’harmonisation ne s’y est toutefois réalisée que de manière imparfaite. C’est la nature essentiellement nationale du contrat d’assurance qui en est la cause. Ainsi, en dépit d’un encadrement renforcé des professionnels – s’agissant notamment de la réglementation prudentielle et de la distribution –, et de la mise en place de règles uniformes destinées à la protection du preneur, le contrat d’assurance demeure principalement régi par les lois nationales. Plusieurs facteurs d’évolution tempèrent néanmoins ce constat. La crise économique et financière de 2008, qui n’a pas épargné le secteur de l’assurance, même s’il n’a pas été le plus touché, a participé au renforcement de l’uniformisation. Elle a ainsi mis en évidence les insuffisances de la régulation européenne et montré combien était nécessaire un encadrement harmonisé de la matière. Les produits d’assurance peuvent en effet s’apparenter à des produits d’investissement – c’est le cas de certains contrats d’assurance-vie – et exposer le preneur à un risque de perte ; dans ce contexte, le législateur européen a procédé à un alignement progressif de la régulation du secteur de l’assurance sur celui des secteurs bancaire et financier, s’agissant notamment de la lutte contre le risque systémique. Il a ainsi, par exemple, mis en place un régime propre aux produits d’investissement fondés sur l’assurance. Au-delà de cette dimension financière, qui modifie en profondeur le droit européen des assurances, on peut constater l’influence grandissante de la réglementation européenne dite horizontale, issue du droit de la concurrence, du droit de la consommation, du droit fiscal, etc., qui s’applique au contrat d’assurance et le modèle indirectement. Le droit européen des assurances se trouve en outre confronté aux événements géopolitiques récents, en particulier au Brexit ou à la guerre en Ukraine, ainsi qu’aux grands débats de société que constituent le développement des technologies digitales (blockchain, intelligence artificielle), l’enjeu crucial du développement durable, et spécifiquement du changement climatique, ou encore le vieillissement de la population, auquel le législateur a apporté récemment une réponse par la création du label «PEPP», désignant les produits paneuropéens d’épargne-retraite individuelle. Autant de défis qui contribueront à façonner le droit européen des assurances de demain.

Book excerpt: This report explores the main reasons behind the unreliable supply of Technetium-99m (Tc-99m) in health-care systems and policy options to address the issue. Tc-99m is used in 85% of nuclear medicine diagnostic scans performed worldwide – around 30 million patient examinations every year. These scans allow diagnoses of diseases in many parts of the human body, including the skeleton, heart and circulatory system, and the brain. Medical isotopes are subject to radioactive decay and have to be delivered just-in-time through a complex supply chain. However, ageing production facilities and a lack of investment have made the supply of Tc-99m unreliable. This report analyses the use and substitutability of Tc-99m in health care, health-care provider payment mechanisms for scans, and the structure of the supply chain. It concludes that the main reasons for unreliable supply are that production is not economically viable and that the structure of the supply chain prevents producers from charging prices that reflect the full costs of production and supply.
