La quinta edizione del Manuale tiene conto della c.d. riforma Cartabia, attuata con tre decreti legislativi emessi in pari data (10 ottobre 2022), i d.lgs. n. 149, n. 150 e n. 151. Nel d.lgs. n. 149 del 2022 interessa la costituzione del tribunale per le persone, per i minorenni e per le famiglie, che esercita pure la giurisdizione in primo grado in materia penale e nella materia della sorveglianza. Nel d.lgs. n. 150 del 2022, che modifica talune norme del codice penale e del codice di procedura penale applicabili nel procedimento minorile, un capitolo a sé è costituito dalla giustizia riparativa, che vi trova una disciplina organica: ora il d.lgs. 19 marzo 2024, n. 31, detta disposizioni integrative e correttive a quest’ultimo decreto. Il d.lgs. n. 151 del 2022 contiene le norme sull’ufficio per il processo. Nella XIX legislatura si è assistito a un iperattivismo normativo sull’onda di drammatiche vicende concrete: sul piano interno, si annoverano provvedimenti ispirati a una logica securitaria, che si pongono spesso in rotta di collisione con i capisaldi del procedimento minorile. In specie, tale aspetto emerge per le misure limitative della libertà personale, con un più severo regime di durata di quelle cautelari, e nel nuovo art. 27-bis d.p.R. n. 448 del 1988 (percorso di rieducazione del minore). Sul versante europeo, vengono tratteggiati gli interventi normativi, a cominciare da quelli che hanno investito le tematiche dell’euro-mandato, della Procura europea, di Eurojust e del contrasto della diffusione di contenuti terroristici on line.
