Book excerpt: Depuis la proclamation de la Déclaration des Droits de l'Homme et du Citoyen, l'accès aux charges publiques suppose non plus des titres de noblesse mais davantage les talents et les mérites de chaque citoyen. Ce principe nouvellement affirmé va subir sporadiquement des fluctuations au cours des régimes postérieurs, mais aujourd'hui il régit encore le droit de la fonction publique d'Etat se confortant même, depuis l'intervention du Conseil Constitutionnel, dans la carrière des agents. Dès l'origine, le concours est apparu comme l'outil le mieux adapté au respect du principe d'égalité. Or, l'étude exhaustive de ce procédé décèle de nombreux écueils inégalitaires. De même, les autres procédés existant statutairement n'offrent pas davantage de conditions objectives de sélection méritocratique. Dès lors, on ne peut légitimement inférer à l'existence du principe d'égalité à l'entrée de la fonction publique. Une conclusion similaire semble poindre en matière de carrière des agents. En effet, malgré l'affirmation explicite d'un principe d'égalité de traitement des fonctionnaires, il est démontré l'ineffectivité de celui-ci et notamment dans le système de notation, d'avancement stricto sensu ou bien dans les retraites des agents publics. Aussi, nous concluons au caractère inopérant du principe d'égalité lors de la carrière des fonctionnaires mais davantage au caractère relatif dudit principe dans le droit de la fonction publique d'Etat.

Cuts in education and training may also have an impact on the quality of human capital in both the public and private sectors, despite the fact that the recent crisis has shown the value of education as employees with better skills and training are more likely to maintain their jobs and incomes. On the economic side, what will be the impact on wages, and on job quantity and quality? On the social side, what will the effects be on inequality and social cohesion? And what will be the outcome for, and potential role of, social partners and social dialogue?
