The foundation of the European project, the promises of Democracy and Human Dignity, need to be assessed. The internal crisis and global challenges require a paradigm shift to establish a new foundation upon which to keep those promises alive. This crisis is multidimensional: environmental, cultural, political, social, economic, etc. and the European Union should tackle it as such. The book aims at contributing to that debate by offering a new conceptual approach to the core ideas of European integration process (sovereignty, diversity, common challenges, etc). By doing so, the edited volume settles the ground for some institutional and legal transformations that may reflect this new narrative for a new Europe.

Book excerpt: The contributions brought together in this book derive from joint seminars, held by scholars between colleagues from the University of Oxford and the University of Paris II. Their starting point is the original divergence between the two jurisdictions, with the initial rejection of the public-private divide in English Law, but on the other hand its total acceptance as natural in French Law. Then, they go on to demonstrate that the two systems have converged, the British one towards a certain degree of acceptance of the division, the French one towards a growing questioning of it. However this is not the only part of the story, since both visions are now commonly coloured and affected by European Law and by globalisation, which introduces new tensions into our legal understanding of what is "public" and what is "private".

As to the ethics, however, there is a problem. Governance and new public management have raised new problems which cannot be solved by referring to the traditional bureaucratic ethics. Devolution and decentralisation processes have enhanced the responsibility of public servants. The increase of transparency and openness and the service orientation of public organisations have challenged the traditional values of discretion and equality before the rule. The growing interaction between the public and the private sector have raised the question of integrity. In light of these developments, it is important to update the ethical system, or reversibly, the traditional values of the public service can question some actual evolutions in government.

After studying the historical roots of both interpretative acts, this research questions the level of protection taxpayers enjoy when relying on circulars and tax rulings and contains a review of decades of administrative case-law to assess the judicial discourse on taxpayers’ rights to certainty. While officially dialogues between different national societies are conducted by diplomats in bilateral and multilateral settings, in practice journalists also participate every day in such dialogues through the phenomenon of the “international media echo” in which they report on each others’ societies. Until now, media have only been investigated for their potential role in the foreign policy of specific states. In a case study involving media in three national cultures and languages (French, American and Russian), this book presents an interdisciplinary framework that combines quantitative and qualitative analyses for the study of the international media echo in an intercultural / international relations perspective. In particular, the fundamental functioning of “spirals of anti-Other rhetoric”, i.e. media wars, is examined in a Critical Discourse Analysis approach completed with Social Identity Theory and International Relations theories.

In each system, deference functions differently, because the positioning of the judiciary with regard to the separation of powers, the role of the courts as a mechanism of checks and balances, and the scope of judicial review differ. In addition, the way deference works within the constitutional system itself is complex, multi-faceted and often covert. Although judicial deference to the administration is a topical theme in comparative administrative law, a general examination of national systems is still lacking.
