Ce livre présente un exposé complet systématique et précis du droit de l'exécution du contrat de transport maritime de marchandises. Il sera d'un grand intérêt pour tous ceux qui s'intéressent au droit maritime : juristes, marins, assureurs, professionnels du transport maritime et enseignants. Par sa double culture juridique marocaine et française et par sa qualité de praticien, l'auteur a montré en quoi les solutions ainsi analysées sont aptes à répondre aux besoins de la pratique et aux intérêts des armateurs, des chargeurs et réceptionnaires, des collectivités portuaires, etc. La bonne exécution du contrat restera toujours l'élément crucial de l'image de marque et de la compétitivité de toute entreprise.

Book excerpt: Depuis le Harter Act de 1893, la liberté contractuelle dans le connaissement a été limitée pour éviter l’abus de la clause de négligence en prenant compte de la protection des intérêts du chargeur. Cette idée a été suivie par les législations ultérieures en le transport maritime. Désormais, le transport maritime est divisé en deux volets : le contrat de transport sous connaissement de ligne régulière et le contrat de transport sous charte-partie dans le tramping, le premier étant assujetti au régime impératif qui protège la partie plus faible; le second est soumis à la liberté contractuelle au motif que les contractants se trouvent sur un pied d’égalité. Après l’entrée en vigueur du Shipping Act de 1984 aux États-Unis, le contrat de service a été introduit afin de renforcer la compétition entre les transporteurs dans la ligne régulière. Le chargeur et le transporteur peuvent librement négocier le taux de fret et les autres conditions du transport. Dans le projet du Carriage of Goods by Sea Act de 1999 aux États-Unis, le contrat de service est concerné. Il n’est pas certain que le contrat de service de ligne régulière soit soumis au régime impératif lorsque les parties se trouvent sur un pied d’égalité. Le projet du COGSA 1999 a donné une grande liberté contractuelle aux parties au contrat de service. Cette idée a été suivie par les Règles de Rotterdam en ce qui concerne le contrat de volume au niveau international. Le contrat de volume connait une grande liberté contractuelle. Le débat est ouvert. Pour les chargeurs, la liberté contractuelle dans le contrat de volume porterait atteinte à leurs intérêts, surtout pour les petits ou moyens chargeurs. Cette préoccupation suscite une attention particulière du législateur des Règles de Rotterdam. Des mesures de sauvegardes ont été mises en place pour éviter tout abus du transporteur. D’une part, des conditions préalables à la réalisation de la liberté contractuelle ont été mises en place. D’autre part, la liberté contractuelle dans le contrat de volume est limitée par des obligations impératives et le principe de bonne foi. En effet, c’est une des questions les plus controversées durant la phase de négociation prévue par les Règles de Rotterdam. Selon certains, elle serait un grand obstacle à l’entrée en vigueur des Règles de Rotterdam. Ainsi, il est nécessaire d’étudier sur cette question d’actualité pour évaluer l’impact de cette convention internationale dans le transport maritime.
