Dès le Xlle siècle, comme il a son dialecte, chaque petit pays a ses coutumes, faites de traditions ethniques et d'habitudes, liées aux modes de vie et de culture et aux vicissitudes politiques. Si ces coutumes ignorent les contrats, elles fixent jusqu'en 1789 le statut de la famille, les règles de la parenté et des successions, les conventions matrimoniales, le droit des biens et, souvent même, celui des personnes. Les coutumes étaient diverses, mais de même qu'il existe des familles dialectales, il existe des familles de coutumes : l'Ouest est lignager, le Nord communautaire, le Midi individualiste, avec, pour chaque province, quelque originalité. Les coutumes expriment la volonté populaire et elles évoluent avec elle. Les juristes, romanistes ou praticiens, dirigent ou contrôlent les changements, de sorte que l'histoire du droit privé rejoint à la fois l'histoire sociale et l'histoire politique. La règle de droit perd tout caractère abstrait pour devenir l'expression parfaite des mentalités d'une époque. Cela apparaît mieux encore dans la deuxième partie du livre consacrée aux institutions de droit privé. Le fait domine le droit: la condition des personnes dépend de leur place dans la société, le statut des biens de la fonction qui leur est reconnue. Pour le droit du mariage, de la famille, des successions, les considérations sociales l'emportent. Même les principes révolutionnaires ne pourront prévaloir contre la tradition et le Code civil devra sa longue fortune à sa fidélité à l'ancien droit.
