While the search for solutions is ongoing one pattern seems to be emerging: Fortress Europe is in the making. Unfortunately, few of these discussions and measures consider the structural root causes and dynamics of migration, the motives of migrants or societal challenges more thoroughly. This book seeks to address this deficit. Taking migration and asylum policies as a starting point, it analyses the various dimensions underpinning migration. In doing so, it identifies why receiving countries are in many ways part of the problem. To eschew an overtly Euro-centric perspective and stimulate a debate between science and politics, it contains contributions by academics and practitioners alike from both shores of the Mediterranean.

Book excerpt: The European Union (EU) is making strong inroads into areas of security traditionally reserved to states, especially into internal security, or Justice and Home Affairs. The Area of Freedom, Security and Justice (AFSJ), as it has been renamed in the Amsterdam Treaty, has seen significant policy developments since the late 1990s. In fact, there has been no other example of a policy-making area making its way so quickly and comprehensively to the centre of the treaties and to the top of the EU’s policy-making agenda. After major treaty revisions in Maastricht, Amsterdam, Nice, and, finally the Lisbon Treaty, which entered into force on 1 December 2009, as well as an increased political impetus through the European Council Summits in Tampere (1999), the Hague (2004), and Stockholm (2009), the area appears as one of the most promising policy fields for integration in the EU in the foreseeable future. This process has deepened even more significantly after the terrorist attacks on 11 September 2001 in the United States, on 11 March 2004 in Madrid, and on 7 July 2005 in London. This book is the first to analyse these hugely topical developments in European internal security at both the treaty and policy levels, as well as its implementation at the national level, from various disciplinary perspectives (political science, law, criminology, etc). The chapters are composed by leading scholars in French and Francophone Studies who engage in interdisciplinary reflections on the ways transcontinental movement has influenced diverse genres. It begins with the premise that an attentiveness to migration has inspired writers, artists, filmmakers, playwrights and musicians to engage in new forms of translation in their work. Their own diverse backgrounds combine with their awareness of the itineraries of others to have an impact on the innovative languages that emerge in their creative production. This book analyses the work of the EU and the Council of Europe in ascertaining a clear framework or a set of criteria suitable to determine those who should be considered vulnerable and disadvantaged. It also explores the measures required to protect their human rights. Key questions can be answered by analysing the different methods used to determine the levels of protection offered by the two European systems. These questions include whether the Convention and the case law of the Strasbourg Court, the monitoring mechanisms of the Council of Europe, EU law and the case law of the European Court of Justice enhance the protection of vulnerable groups and expand the protection of their rights, or, alternatively, whether they are mainly used to fill in relatively minor gaps or occasional lapses in national rights guarantees. The analysis also shows the extent to which these two European systems provide analogous, or indeed divergent, standards and how any such divergence might be problematic in light of the EU accession to the European Convention on Human Rights.
