Se colui che si è posto la domanda ha abbandonato precocemente gli studi ed è andato a fare l’operaio, sa che il suo datore di lavoro e lui stesso versano mensilmente a un istituto di previdenza i contributi in vista della costituzione di un capitale col quale gli verrà pagata la pensione quando avrà cessato di lavorare: e li hanno versati, i contributi, perché erano obbligati a farlo. Se si è sposato, lo ha fatto in municipio davanti al sindaco o a un suo delegato che ha annotato il matrimonio, sempre sui registri dello stato civile; se si è sposato in chiesa, ciò è avvenuto davanti a un celebrante che, al termine della cerimonia, ha svolto quella stessa funzione che avrebbe svolto il sindaco se si fosse sposato in municipio. Se si è dato al commercio, ricorda di averlo potuto fare solo dopo che ha ottenuto dal Comune l’autorizzazione ad aprire bottega ed ha ricevuto da altro ufficio l’autorizzazione ad attrezzare i locali in conformità a un progetto elaborato in funzione dell’attività commerciale. Il nostro immaginario personaggio ricorda che nel corso della sua vita ha avuto diecine di incontri con uffici pubblici: incontri e spesso scontri. Come quando, dopo aver chiesto un permesso, se lo è visto negare, o quando ha ricevuto dall’ANAS la comunicazione della imminente espropriazione di un terreno di sua proprietà o quando, diciottenne, si è visto recapitare al suo indirizzo la cartolina precetto che lo chiamava alle armi. In tutti questi casi il privato ha come interlocutore un apparato pubblico, una pubblica amministrazione: un’entità con la quale entra in rapporto o perché è costretto a farlo – se non fosse autorizzato non potrebbe costruire la casa che intende realizzare sul suo terreno – o perché ha un interesse a farlo (ce l’ha, questo interesse, quando chiede un contributo sul capitale necessario ad un investimento produttivo) – o perché questo rapporto lo subisce (negli esempi fatti: l’e¬spropriazione e la chiamata alle armi). Se poi il nostro uomo domanda perché è stato costretto ad instaurare questi rapporti o perché ha dovuto subire l’iniziativa di un pubblico ufficio volta a limitare la sua libertà o la sua proprietà, si sentirà rispondere che ciò è avvenuto nell’interesse pubblico. L’interesse pubblico all’ordinato uso del territorio che subordina la facoltà di edificare ad un permesso rilasciato dal Comune; l’interesse pubblico all’apertura di una nuova strada o all’allargamento di una strada esistente che esige il sacrificio di una parte del suo terreno; l’interesse pubblico alla difesa della patria che gli ha imposto di prestare il servizio militare. Ma che cos’è questo interesse pubblico?
