L'éclairage proposé est issu du droit positif européen, en particulier français. Il se fonde sur les libertés publiques ou libertés individuelles. Celles-ci sont inaliénables: les enfants, les adolescents, les incapables majeurs... en sont titulaires. Seul l'exercice de ces droits et libertés leur est limité sous l'autorité des tuteurs: parents, familles, médecins, enseignants, services sociaux... Mais ces libertés sont doublement contingentes. Socialement, aucune d'entre elles n'est absolue ni illimitée. Le droit à la sûreté, par exemple, et la liberté d'aller et venir s'opposent en permanence dans la pratique de soins et d'éducation. D'autre part, ces libertés sociales s'intriqent de façon variable avec les contraintes internes, les interdits, les illusions ou les défenses de chaque individu. L'Etat de droit impose à tout professionnel de la Santé ou de l'Education de garantir ces droits et libertés aux enfants et aux adolescents. Mais comment articuler ces contradictions dynamiques et avec quels moyens ?

Enfin, il est des situations particulières vécues par les enfants (enfant malade, enfant à l'école, enfant au travail ou en apprentissage, enfant étranger, enfant délinquant) qui soulèvent des questions sensibles qui font débat.
