LOIN D'ETRE NEGLIGEABLE SUR UN PLAN QUANTITATIF, CETTE MISSION CONCERNE TANT LE JUGE ADMINISTRATIF, SPECIAL OU DE DROIT COMMUN, CHARGE DE PUNIR DIRECTEMENT DES COMPORTEMENTS REPREHENSIBLES COMME LE FERAIENT LES JURIDICTIONS PENALES DU PREMIER DEGRE, QUE LE JUGE ADMINISTRATIF DONT LE ROLE EST DE STATUER SUR LA LEGALITE DES SANCTIONS INFLIGEES PAR DES AUTORITES ADMINISTRATIVES. FACE A L'EPANOUISSEMENT CROISSANT DE SANCTIONS APPLICABLES PAR DES AUTORITES AUTRES QUE LE JUGE PENAL, LA TACHE DU JUGE ADMINISTRATIF REPRESSIF S'EST CONSIDERABLEMENT DEVELOPPEE. SA PRINCIPALE ACTIVITE A ETE DE BATIR UN DROIT DE LA SANCTION EN DROIT ADMINISTRATIF, COMMUNEMENT DENOMME DROIT ADMINISTRATIF REPRESSIF, EN PRENANT LA PRECAUTION DE RESPECTER LES EXIGENCES POSEES PAR LE CONSEIL CONSTITUTIONNEL ET LA COUR EUROPEENNE DES DROITS DE L'HOMME. LA CONSTRUCTION DU DROIT ADMINISTRATIF REPRESSIF QUI EN DECOULE EST EN CONSTANTE PROGRESSION, MEME SI CERTAINES LACUNES PERSISTENT, LES REGLES TRADITIONNELLES DU PROCES ADMINISTRATIF SE REVELANT PARFOIS SUFFISANTES POUR GARANTIR L'EFFICACITE D'UN PROCES DE TYPE REPRESSIF.

Book Environmental Damage in International and Comparative Law

Download or read book Environmental Damage in International and Comparative Law written by Michael Bowman and published by Oxford University Press, USA. This book was released on 2002 with total page 390 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study considers the problems of defining and valuing "environmental damage" from the perspective of international and comparative law. The need for a broad and systematic evaluation of this issue is illustrated by the number of topics presently on the international law-making agenda to which it is relevant, including the UN Compensation Commission's decisions on compensation for environmental losses suffered by Kuwait in the Gulf War, nuclear and oil pollution liability regimes, the development of an environmental liability protocol to the Antarctic Treaty and other agreements on bio-safety and genetically modified organisms. It is thus an important element in contemporary efforts to strengthen legal remedies for environmental harm which does not necessarily come within traditional categories of legally protected personal or property rights.

Available in PDF, EPUB and Kindle. Book excerpt: An analysis of transitional justice - retribution and reparation after a change of political regime - from Athens in the fifth century BC to the present. Part I, 'The Universe of Transitional Justice', describes more than thirty transitions, some of them in considerable detail, others more succinctly. Part II, 'The Analytics of Transitional Justice', proposes a framework for explaining the variations among the cases - why after some transitions wrongdoers from the previous regime are punished severely and in other cases mildly or not at all, and victims sometimes compensated generously and sometimes poorly or not at all. After surveying a broad range of justifications and excuses for wrongdoings and criteria for selecting and indemnifying victims, the 2004 book concludes with a discussion of three general explanatory factors: economic and political constraints, the retributive emotions, and the play of party politics.

Download or read book The Wages of Guilt written by Ian Buruma and published by New York Review of Books. This book was released on 2015-09-01 with total page 345 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this now classic book, internationally famed journalist Ian Buruma examines how Germany and Japan have attempted to come to terms with their conduct during World War II—a war that they aggressively began and humiliatingly lost, and in the course of which they committed monstrous war crimes. As he travels through both countries, to Berlin and Tokyo, Hiroshima and Auschwitz, he encounters people who are remarkably honest in confronting the past and others who astonish by their evasions of responsibility, some who wish to forget the past and others who wish to use it as a warning against the resurgence of militarism. Buruma explores these contrasting responses to the war and the two countries’ very different ways of memorializing its atrocities, as well as the ways in which political movements, government policies, literature, and art have been shaped by its shadow. Today, seventy years after the end of the war, he finds that while the Germans have for the most part coped with the darkest period of their history, the Japanese remain haunted by historical controversies that should have been resolved long ago. Sensitive yet unsparing, complex and unsettling, this is a profound study of how people face up to or deny terrible legacies of guilt and shame.

Book Africa from the Sixteenth to the Eighteenth Century

Download or read book Africa from the Sixteenth to the Eighteenth Century written by Bethwell A. Ogot and published by Univ of California Press. This book was released on 1992 with total page 1088 pages. Available in PDF, EPUB and Kindle. Book excerpt: The result of years of work by scholars from all over the world, The UNESCO General History of Africa reflects how the different peoples of Africa view their civilizations and shows the historical relationships between the various parts of the continent. Historical connections with other continents demonstrate Africa's contribution to the development of human civilization. Each volume is lavishly illustrated and contains a comprehensive bibliography. This fifth volume of the acclaimed series covers the history of the continent from the beginning of the sixteenth century to the close of the eighteenth century in which two themes emerge: first, the continuing internal evolution of the states and cultures of Africa during this period second, the increasing involvement of Africa in external trade--with major but unforeseen consequences for the whole world. In North Africa, we see the Ottomans conquer Egypt. South of the Sahara, some of the larger, older states collapse, and new power bases emerge. Traditional religions continue to coexist with both Christianity (suffering setbacks) and Islam (in the ascendancy). Along the coast, particularly of West Africa, Europeans establish a trading network which, with the development of New World plantation agriculture, becomes the focus of the international slave trade. The immediate consequences of this trade for Africa are explored, and it is argued that the long-term global consequences include the foundation of the present world-economy with all its built-in inequalities.
