Without underplaying the future potential of technological innovation, or the need for a fair and rational system for the prioritisation and funding of legal services, the book questions whether the absolutist approach to the dictates of austerity and the promise of new technologies that have driven the Coalition Government's policy, can be squared with obligations to protect the fundamental right of access to justice, in the unwritten constitution of the United Kingdom.

The authors focus their analysis on lawyers in independent practice in modern capitalist constitutional regimes, including the United States, Japan, Europe, and Latin America, as well as the emerging legal systems in China and the former Soviet bloc, to develop connections between the legal profession and political systems based on the rule of law. They find that although ethical tension is inherent in the legal practice of all these societies, the legal profession is essential to stable political institutions.

It documents how change and resistance are inextricably tied together in an oppositional tension where the greater weight shifts gradually from one to the other, even shifts backwards at times, but in the long view runs in the direction of change. The most obvious instance almost everywhere is the struggle of women in legal professions where improvement is undeniable even as resistance is varied and stiff. The book charts the way demographic shifts have changed the work of lawyers, the way that the revenue from law practice has been re-distributed, and the extent to which barriers based on race, class, religion and gender have shrunk or shifted. It describes how some professions have been forced by government or co-regulation with government to reorganize. It also documents how others have not kept pace with transformations in the economy and changes and challenges to legal education take center stage while demographic shifts and institutional reorganization are of much less importance.

It is the first such book to bring together historical work on legal aid in a comparative perspective, and allows readers to analogise and contrast historical narratives about free legal aid across countries. Legal aid developed as a result of industrialisation, urbanization, immigration, the rise of philanthropy, and what were viewed as new legal problems. Closely related, was the growing professionalisation of lawyers and the question of what duties lawyers owed society to perform free work. Yet, legal aid providers in many countries included lay women and men, leading at times to tensions with the bar. Furthermore, legal aid often became deeply politicized, creating dramatic conflicts concerning the rights of the poor to have equal access to justice.

It was in that city in the sixteenth century that, prompted by his Dominican brothers, such as Bartolome de las Casas, who were defending the indigenous people of Latin America against the Spanish conquistadores, Francisco de Vitoria planted the seed of today's international human rights movement. This volume presents in original languages the eleven papers given in Salamanca as well as the statement adopted by the delegates at the end of the meeting. They combine historical views, theoretical insights and testimonies from life experience. This offers a rich contribution, not only towards strengthening the role of the Dominican Family, and even the universal church, in defending human rights, but also towards a deeper understanding of 'evangelisation' and 'mission'.
