Book excerpt: La Côte d’Ivoire est en quête d’une stratégie de développement qui lui permettra d’atteindre le statut de pays à revenu intermédiaire, ce qui représente un défi qui nécessiterait un taux de croissance annuel de 10 % pendant plus de 13 ans. L’expérience des économies développées et émergentes démontre que le produit intérieur brut (PIB) par habitant augmente avec la progression de l’urbanisation. Néanmoins, l’économie de la Côte d’Ivoire affiche des performances insuffisantes sur le plan de l’urbanisation. L’urbanisation et le revenu par habitant ont une corrélation négative depuis la fin des années 1970, et la pauvreté augmente. Au lieu d’envisager le développement des villes individuellement, un plan d’urbanisation réussie devrait considérer les villes de la Côte d’Ivoire comme un portefeuille d’actifs qui se distinguent les uns des autres par leur taille, leur emplacement et la densité de leur population. Les auteurs de L’Urbanisation diversifiée : Le cas de la Côte d’Ivoire identifient trois types de villes, fondées sur leurs contributions à la croissance et à la création d’emplois : les connecteurs globaux ; les connecteurs régionaux, situées le long des corridors d’échanges et des transports régionaux ; et les connecteurs locaux, qui génèrent les économies de localisation nécessaires à l’agro-industrie. Les parties prenantes des administrations nationales et infranationales et du secteur privé ont formulé une vision commune de l’urbanisation en Côte d’Ivoire : « villes planifiées, structurées, compétitives, attractives, inclusives et organisées autour de pôles de développement ». Afin de réaliser cette vision et d’atteindre le statut de pays à revenu intermédiaire, les décideurs politique ivoiriens doivent agir de toute urgence pour promouvoir une urbanisation diversifiée pour tous les types de villes. Cette présente étude identifie des contraintes principales et des enjeux dans quatre domaines : la planification, les connexions, l’écologisation, et le financement des villes.

The book is focused on intersectionality between gender, race and disability and the question of whether, and to what extent, this intersection can be adequately addressed in (EU) law. The discussion rests on two basic assumptions. First, the multiplication of 'discrimination grounds' in EU law and other legal regimes should not result in a dilution of the demands of equality law. Accordingly, the book focuses on the three key grounds - race, gender and disability. These constitute nodes around which other discrimination grounds can be grouped. Second, any multi-ground non-discrimination law framework needs to engage with the question of discrimination on several grounds. This book provides a critical evaluation of some of the problems presented by such intersectionality and an opportunity to explore the issues in depth. This collection offers some new proposals relating to the regrouping of identity categories and to the general approach to socio-legal research in the field. Instead, the region presents differing situations and social experiences born of the varying colonial systems from which they were developed. Using the Caribbean experience as the focus, Christine Chivallon examins the transatlantic slave trade and slavery as founding events in the identification of a black diaspora experience. The exploration is extended to include the United States to exemplify contrasting situations in slavery-based systems and identifies the links between the expressions of culture emanting from the black populations of the New World and the diversity of interpretations of the cultural identities of the black Americas.Divided into three main parts, The Black Diaspora of the Americas firstly examines the foundation of the black experiences of the New World by considering the slave trade. The second part takes a more theoretical examination of 'black diaspora' using Rastafarianism, Garveyism and Pan-Africanism while referencing the work of a range of thinkers including Stuart Hall, Paul Gilroy, Richard Price, douard Glissant, Melville Herskovits and Sidney Mintz. Often compared with the space programme, this vast enterprise still generates misgivings: this new power, which human beings now have, to modify the genetic heritage of living creatures raises fundamentally new ethical questions - and society as a whole will have to find the answers. In fact, the accelerating pace of scientific and technical progress seems to be reviving atavistic anxieties, some rational, others less so. Recent public-health crises, including the mad cow disease' scare, which lasted into 2000, have fuelled these fears. The public's rejection of GMOs (Genetically Modified Organisms) - verging on a crusade in some countries - tells its own story. As regards conflict, 2000 saw the Middle East peace process grind to a halt, and the Intifada resume. In Europe, the situation in Kosovo and Chechnya, both the scenes of fighting in 1999, stayed precarious. Peace and democracy did score some successes, however, particularly in Europe: the centre-left's victory in Croatia, sweeping former President Tudjman's party off the scene, the democratic party's triumph in Bosnia, and the fall of the Milosevic regime in Serbia.

Book excerpt: This book explores various approaches around the world regarding price term control, and particularly discusses the effectiveness of two major paths: ex ante regulatory and ex post judicial intervention. Price control and its limits are issues that affect all liberal market economies, as well as more regulated markets. For the past several years, courts in many different countries have been confronted with the issue of whether, and to what extent, they should intervene regarding price-related terms in standard form contracts – especially in the area of consumer contracts. Open price clauses, flat remunerations, price adjustment clauses, clauses giving the seller/supplier the right to ask for additional payments, bundling or partitioning practices, etc.: a variety of price related terms are used to manipulate customers’ choices, often also by exploiting their behavioral biases. The result is an unfavorable contract that is later challenged in court. However, invalidating a given price term in standard forms e.g. of a banking or utilities contract only has an inter partes effect, which means that in thousands if not millions of similar contracts, the same clauses continue to be used. Effective procedural rules are often lacking. Therefore, pricing patterns that serve to hide rather than to reveal the real cost of goods and services require special attention on the part of regulators. The aim of this book is to determine the various approaches in the world regarding price term control, and particularly to discuss the efficiency of both paths, ex ante regulatory and ex post judicial intervention. Thanks to its broad comparative analysis, this book offers a thorough overview of the methods employed in several countries. It gathers twenty-eight contributions from national rapporteurs and one supra-national rapporteur (EU) to the 2018 IACL Congress held in Fukuoka. These are supplemented by a general report presented at the same IACL Congress, which includes a comparative analysis of the national and supranational reports.
