Book The Oxford Handbook of International Cultural Heritage Law

Download or read book The Oxford Handbook of International Cultural Heritage Law written by Francesco Francioni and published by Oxford University Press. This book was released on 2020-07-30 with total page 1024 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Handbook provides a cutting edge study of the fast developing field of international law on the protection of cultural heritage by taking stock of the recent developments and of the core concepts and current challenges. The legal protection of cultural heritage has come under renewed focus from the international community and states since the 1990s. This is evidenced by the adoption of a range of international instruments. Countries are also enacting cultural heritage legislation or overhauling existing laws within their own national territory. Contributions address the protection of immovable and movable, tangible and intangible cultural heritage in peacetime and in the event of armed conflict as well as the interaction between specific regimes of cultural heritage protection with other fields of international law, including international criminal law, human rights and humanitarian law, environmental law, international trade, investments, and intellectual property. The last part of the Handbook covers diverse regional systems of heritage protection.

  • Author : Stefan Koldehoff
  • Publisher : Seven Stories Press
  • Release : 2022-07-12
  • ISBN : 1644211203
  • Pages : 351 pages

Download or read book Art Crime written by Stefan Koldehoff and published by Seven Stories Press. This book was released on 2022-07-12 with total page 351 pages. Available in PDF, EPUB and Kindle. Book excerpt: A thrilling, eye-popping look at true crime in the billion-dollar art world. The art world is one of the most secretive of global businesses, and the list of its crimes runs long and deep. Today, with prices in the hundreds of millions for individual artworks, and billionaires' collections among the most conspicuous and liquid of their assets, crime is more rampant than ever in this largely unregulated universe. Increased prices and globalization have introduced new levels of fraud and malfeasance into the art world--everything from "artnapping," in which an artwork is held hostage and only returned for a ransom, to forgery and tax fraud. However, the extent of the economic and cultural damage that results from criminality in the global art scene rarely comes to light. The stories of high-stakes, brazen art crimes told by art experts Stefan Koldehoff and Tobias Timm are by turns thrilling, disturbing, and unbelievable (the imagination for using art to commit crimes seems boundless). The authors also provide a well-founded analysis of what needs to change in the art market and at museums. From the authors of False Pictures, Real Money (about the Beltracchi art forgery case), Art and Crime includes a chapter on art owned by Donald Trump. It is a thoroughly researched, explosive, and highly topical book that uncovers the extraordinary and multifarious thefts of art and cultural objects around the world.

Book Academic Freedom Under Pressure

Download or read book Academic Freedom Under Pressure written by Margrit Seckelmann and published by Springer Nature. This book was released on 2021-08-26 with total page 259 pages. Available in PDF, EPUB and Kindle. Book excerpt: Is academic freedom threatened? The book examines current challenges to academic freedom in Europe, focusing mainly on Italy and Germany. The cases discussed demonstrate that research and teaching are under pressure in European democracies: in Hungary and Poland due to political constraints, in other countries due to societal expectations. Considering different interrelated aspects, the four parts of the book explore many real and potential threats to universities, scientific institutions and researchers, ranging from the European dimension of freedom of the arts and sciences to comparative analysis of emerging challenges to academic freedom against the backdrop of the COVID-19 pandemic. They highlight threats to university autonomy from the economic orientation of university governance, which emphasizes efficiency, competition, and external evaluation, and from new rules concerning trigger warnings, speech restrictions, and ethics commissions. Detailed study of these complex threats is intended to stimulate scholarly reflection and elicit serious discussion at European and national level. The volume contributes to the search for a new role of universities and scientific institutions and is addressed to academics and political stakeholders.

Book The 1970 UNESCO and 1995 UNIDROIT Conventions on Stolen or Illegally Transferred Cultural Property

Download or read book The 1970 UNESCO and 1995 UNIDROIT Conventions on Stolen or Illegally Transferred Cultural Property written by and published by Oxford University Press. This book was released on 2024-02-29 with total page 945 pages. Available in PDF, EPUB and Kindle. Book excerpt: The illicit traffic in cultural objects is a grave concern to the general public and international community. The resulting cultural damage fuels debates on how best to regulate the trade in cultural objects and inform legal responses at all levels for the protection of movable cultural heritage. Treaties concerning the treatment of cultural objects during peacetime and war represent some of the earliest multilateral initiatives on cultural heritage in the modern era. They also remain some of the most deeply contested, representing shifting fault lines within the international community. Authored by leading scholars and practitioners from around the world, this Commentary is the first to cover the two leading multilateral treaties on movable cultural heritage in one volume: the Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property adopted by UNESCO in 1970 and the Convention on Stolen or Illegally Exported Cultural Objects adopted by UNIDROIT in 1995. This Commentary is designed to be the authoritative text for academics, lawyers, policymakers, and diplomats on the protection and regulation of cultural objects. Encompassing both public and private international law rules on the trade in cultural objects, it provides a detailed historical and thematic overview. Drawing on the travaux preparatoires and intergovernmental and state practice over the last half century, the Commentary provides an article-by-article analysis of the interpretation and application of these treaties. The texts 1970 UNESCO and 1995 UNIDROIT Conventions are examined in the working context of other culture conventions including the World Heritage Convention and the Intangible Heritage Convention, as well as related fields of international law, such as international humanitarian law, international criminal law, human rights law, and international economic law. The volume also offers a critical examination of current trends and future directions which are informing the field.

Book A Regulatory Framework for the Art Market

Download or read book A Regulatory Framework for the Art Market written by Anna Bolz and published by Springer Nature. This book was released on 2022-11-24 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book addresses practical issues in connoisseurship and authentication, as well as the legal implications that arise when an artwork’s authenticity is challenged. In addition, the standards and processes of authentication are critically examined and the legal complications which can inhibit the expression of expert opinions are discussed. The notion of authenticity has always commanded the attention of art market participants and the general art-minded public alike. Coinciding with this, forgery is often considered to be the world’s most glamorous crime, packed with detective stories that are usually astonishing and often bizarre. The research includes findings by economists, sociologists, art historians, lawyers, academics and practitioners, all of which yield insights into the mechanics and peculiarities of the art business and explain why it works so differently from other markets. However, this book will be of interest not only to academics, but to everyone interested in questions of authenticity, forgery and connoisseurship. At the same time, one of its main aims is to advocate best practices in the art market and to stress the importance of cooperation among all disciplines with a stake in it. The results are intended to offer guidance to art market stakeholders, legal practitioners and art historians alike, while also promoting mutual understanding and cooperation.

Focusing on Greimasian semiotics, it examines specific works of art (from Giotto to Banksy) that deal with the theme of justice, promoting a more sensitive and humanized perception of the values that surround law. The book offers readers a comprehensive review of the semiotics of law, critically examining the relation between law & art. It covers a variety of topics, including semiotics, law and art; semiotics, art and experience; and society, law and art, as well as semiotics, law and painting; semiotics, law and architecture; semiotics, law and theatre; semiotics, law and literature; and semiotics, law and culture. In doing so, it uses the semiotics of painting to explain the symbology of justice and its significance in history; the semiotics of architecture to explain the setting of justice; the semiotics of theatre to explain the logic of the legal process; and the semiotics of literature to explain the narrative logic of legal decisions. Lastly, drawing on the semiotics of culture, it discusses ways of promoting justice, citizenship and human rights. Written from both philosophical and semiotical perspectives, the book enhances the centrality of visual jurisprudence studies to promote a better understanding of the role of law.

Book Art Judgements Art on Trial in Russia after Perestroika

Download or read book Art Judgements Art on Trial in Russia after Perestroika written by Sandra Frimmel and published by Vernon Press. This book was released on 2022-03-29 with total page 318 pages. Available in PDF, EPUB and Kindle. Book excerpt: An unusually large number of court cases against art, artists, and curators have taken place in Russia since the turn of the century. In reference to two of the most prominent, against the organizers of the exhibitions 'Caution, Religion!' and 'Forbidden Art 2006', the author examines the ways in which the meaning of art and its socio-political effects are argued in court: How do these trials attempt to establish a normative concept of art, and furthermore a binding juridical understanding of art? How is the discussion of what is permissible in art being framed in Russia today? Research into the post-Soviet art trials has been mainly journal-driven until today. Only the fairly recent trials of the Pussy Riot activists and Pyotr Pavlensky provoked lengthy publications, but these are mostly concerned with explicitly political and activist art rather than its particular discourse when on trial. This book, however, takes a scholarly approach towards (Russian) art on trial. It puts the cases in a national-historical context, which is compared from international perspectives, and particularly focuses on the way in which these proceedings have intensified juridical power over artistic freedom (of speech) in the production of art in Russia. This book will appeal to academics and students in the areas of art history, cultural science, sociology, and Slavic studies, as well as jurists, curators and museum specialists, researchers and employees in cultural institutions.

Book Transcultural Diplomacy and International Law in Heritage Conservation

Download or read book Transcultural Diplomacy and International Law in Heritage Conservation written by Olimpia Niglio and published by Springer Nature. This book was released on 2021-05-02 with total page 435 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a substantial contribution to understanding the international legal framework for the protection and conservation of cultural heritage. It offers a range of perspectives from well-regarded contributors from different parts of the world on the impact of law in heritage conservation. Through a holistic approach, the authors bring the reader into dialogue around the intersection between the humanities and legal sciences, demonstrating the reciprocity of interaction in programs and projects to enhance cultural heritage in the world. This edited volume compiles a selection of interesting reflections on the role of cultural diplomacy to address intolerances that often govern international relations, causing damage to human and cultural heritage. The main purpose of this collection of essays is to analyse the different cultural paradigms that intervene in the management of heritage, and to advocate for improvements in international laws and conventions to enable better cultural policies of individual nations for the protection of human rights. The editors submit that it is only through open dialogue between the humanities and jurisprudence that the international community will be able to better protect and value sovereignty, and promote cultural heritage for the development of a better world. This collection is relevant to scholars working in areas relating to law, management and policies of cultural heritage conservation and protection.

Book New Approach to Cultural Heritage

Download or read book New Approach to Cultural Heritage written by Le Cheng and published by Springer Nature. This book was released on 2021-10-26 with total page 352 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book addresses questions about theories of heritage, its methodologies of research, and where its boundaries lie with tourism, urban development, post-disaster recovery, collective identities, memory, or conflict. This book is a collection of heritage studies from a critical perspective as a product of the 2018 ACHS (Association of Critical Heritage Studies) Conference in Hangzhou, the largest conference of its kind in Asia. The contributors cover a wide spectrum of issues in heritage studies, such as heritage management, accessibility to heritage, heritage conservation and heritage policy, and heritage representation. It also examines the various contexts within which heritage emerges and how heritage is constructed within that context. Analyses are based on not only representations of heritage but also on the performativity. Explorations touch upon community involvement, landscape history, children’s literature, endangered food, architecture, advertisement, allotment garden, and gender and visual art. As heritage has always been a locus of contested verities, the book offers a variegated approach to heritage studies. It provides students and scholars new perspectives on heritage study.
