Book A Regulatory Framework for the Art Market

Download or read book A Regulatory Framework for the Art Market written by Anna Bolz and published by Springer Nature. This book was released on 2022-11-24 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book addresses practical issues in connoisseurship and authentication, as well as the legal implications that arise when an artwork’s authenticity is challenged. In addition, the standards and processes of authentication are critically examined and the legal complications which can inhibit the expression of expert opinions are discussed. The notion of authenticity has always commanded the attention of art market participants and the general art-minded public alike. Coinciding with this, forgery is often considered to be the world’s most glamorous crime, packed with detective stories that are usually astonishing and often bizarre. The research includes findings by economists, sociologists, art historians, lawyers, academics and practitioners, all of which yield insights into the mechanics and peculiarities of the art business and explain why it works so differently from other markets. However, this book will be of interest not only to academics, but to everyone interested in questions of authenticity, forgery and connoisseurship. At the same time, one of its main aims is to advocate best practices in the art market and to stress the importance of cooperation among all disciplines with a stake in it. The results are intended to offer guidance to art market stakeholders, legal practitioners and art historians alike, while also promoting mutual understanding and cooperation.

Book Tax Incentives for the Creative Industries

Download or read book Tax Incentives for the Creative Industries written by Sigrid Hemels and published by Springer. This book was released on 2017-01-04 with total page 249 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book combines insights from cultural economics, public finance, and tax law, providing an accessible and comprehensive introduction in the application of tax incentives for the creative industries. It does not have a single-country focus, but instead uses the perspective and examples of various countries around the world. The book starts with a theoretical part, introducing the concepts of creative industries and of tax incentives: how can the creative industries be defined, why do governments support the creative industries and how can tax incentives be applied as policy instrument. In the globalized and digitalized world in which the creative industries operate, restrictions imposed by guidelines on harmful tax competition and state aid and regulations influencing the (im)possibility of applying tax incentives in cross-border situations have a great impact. For that reason these legal concepts are discussed as well in the theoretical part. Globalization also gives rise to questions on the cross border application of tax incentives. The example of cross border giving is discussed in this respect. The theoretical part is followed by a part that focuses on tax incentives for specific sectors of the creative industries: museums and cultural heritage, the audiovisual industries (film, tv and videogames), the art market, copyright and artists. This part uses insightful examples from various countries to illustrate the application of these tax incentives. As the book takes both an academic and a practical approach, it is of relevance to researchers, students, policy makers and readers involved in the creative industry who seek an in-depth and up-to-date overview of this alternative way for governments to support the creative industries.

It provides recent court decisions; examples of relevant ethical, sociological, political and legal conflicts; and nearly 50 problems posed for analysis. Book New Approach to Cultural Heritage

Available in PDF, EPUB and Kindle. Book excerpt: This book addresses questions about theories of heritage, its methodologies of research, and where its boundaries lie with tourism, urban development, post-disaster recovery, collective identities, memory, or conflict. This book is a collection of heritage studies from a critical perspective as a product of the 2018 ACHS (Association of Critical Heritage Studies) Conference in Hangzhou, the largest conference of its kind in Asia. The contributors cover a wide spectrum of issues in heritage studies, such as heritage management, accessibility to heritage, heritage conservation and heritage policy, and heritage representation. It also examines the various contexts within which heritage emerges and how heritage is constructed within that context. Analyses are based on not only representations of heritage but also on the performativity. Explorations touch upon community involvement, landscape history, children’s literature, endangered food, architecture, advertisement, allotment garden, and gender and visual art. As heritage has always been a locus of contested verities, the book offers a variegated approach to heritage studies. It provides students and scholars new perspectives on heritage study.

Book The Oxford Handbook of International Cultural Heritage Law

Download or read book The Oxford Handbook of International Cultural Heritage Law written by Francesco Francioni and published by Oxford University Press, USA. This book was released on 2020-05-13 with total page 1089 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Handbook sets out and assesses the international legal framework governing the protection of cultural heritage. Cultural heritage is frequently not bounded by national territory and can only effectively be protected through international cooperation. This is a primary driving force of contemporary multilateral, regional and bilateral initiatives, including legal measures. Accordingly, the handbook is primarily focused on public international law, but it embraces also aspects of private international law and comparative law. It analyses the substance of cultural heritage protection and explores its links with other areas of public and private international law, as well as the ways in which cultural heritage law is contributing to the development of international law itself. The book concludes with an examination of the implementation of cultural heritage law and of regional approaches. It reflects the diversity of developments in almost every field of international law which is leading to this specialist area of law, and provides an overarching rationale for understanding and teaching cultural heritage law as a coherent body of law with key principles and practices. The book is designed in such a manner to enable a reader, whether it be a practitioner, policymaker, teacher or student, to pick and choose according their individual needs

Book Legal Theory of Auction

    Book Details:
  • Author : Kristijan Poljanec
  • Publisher : Taylor & Francis
  • Release : 2022-09-09
  • ISBN : 1000647153
  • Pages : 245 pages

Download or read book Legal Theory of Auction written by Kristijan Poljanec and published by Taylor & Francis. This book was released on 2022-09-09 with total page 245 pages. Available in PDF, EPUB and Kindle. Book excerpt: The widespread understanding of auction structure considers auction as consisting of three contracts: contract between the seller and the auctioneer, contract between the auctioneer and the buyer and the sale contract between the seller and the buyer. The book challenges this concept, arguing that the traditional tripartite concept of auction is too narrow and does not correspond to the actual structure of auction relations. Demonstrating that an auction structure consists of a plethora of legal relationships, including noncontractual relations, this book explores the legal concept of auction sale and the structure of accompanying relations. The book provides a historical overview of auctions and different auction models. Following a brief introduction to the economic theory, auction models are examined against the following legal criteria: price formation, publicity, parties’ autonomy, legal form and applied technology to find a legal concept and nature of auction. The book explores the legal position of key auction figures and auction objects to identify the categories of legal relations that appear at auction. It explores the legal nature of the main contract, as well as the relations between the consignor and the auctioneer, the auctioneer and the bidders, the bidders themselves, the consignor and the bidders. The book covers relations arising from droit de suite, financial and bidding agreements to provide a comprehensive overview of lesserknown legal relations that commonly arise in auction practice.

Book Confronting Colonial Objects

    Book Details:
  • Author : Carsten Stahn
  • Publisher : Oxford University Press
  • Release : 2023-10-13
  • ISBN : 019269412X
  • Pages : 593 pages

Download or read book Confronting Colonial Objects written by Carsten Stahn and published by Oxford University Press. This book was released on 2023-10-13 with total page 593 pages. Available in PDF, EPUB and Kindle. Book excerpt: The treatment of cultural colonial objects is one of the most debated questions of our time. Calls for a new international cultural order go back to decolonization. However, for decades, the issue has been treated as a matter of comity or been reduced to a Shakespearean dilemma: to return or not to return. Confronting Colonial Objects seeks to go beyond these classic dichotomies and argues that contemporary practices are at a tipping point. The book shows that cultural takings were material to the colonial project throughout different periods and went far beyond looting. It presents micro histories and object biographies to trace recurring justifications and contestations of takings and returns while outlining the complicity of anthropology, racial science, and professional networks that enabled colonial collecting. The book demonstrates the dual role of law and cultural heritage regulation in facilitating colonial injustices and mobilizing resistance thereto. Drawing on the interplay between justice, ethics, and human rights, Stahn develops principles of relational cultural justice. He challenges the argument that takings were acceptable according to the standards of the time and outlines how future engagement requires a re-invention of knowledge systems and relations towards objects, including new forms of consent, provenance research, and partnership, and a re-thinking of the role of museums themselves. Following the life story and transformation of cultural objects, this book provides a fresh perspective on international law and colonial history that appeals to audiences across a variety of disciplines. This is an open access title available under the terms of a CC BY-NC-ND 4.0 International licence. It is free to read on the Oxford Academic platform and offered as a free PDF download from OUP and selected open access locations.

Book Art Crime

  • Author : Stefan Koldehoff
  • Publisher : Seven Stories Press
  • Release : 2022-07-12
  • ISBN : 1644211203
  • Pages : 351 pages

Download or read book Art Crime written by Stefan Koldehoff and published by Seven Stories Press. This book was released on 2022-07-12 with total page 351 pages. Available in PDF, EPUB and Kindle. Book excerpt: A thrilling, eye-popping look at true crime in the billion-dollar art world. The art world is one of the most secretive of global businesses, and the list of its crimes runs long and deep. Today, with prices in the hundreds of millions for individual artworks, and billionaires' collections among the most conspicuous and liquid of their assets, crime is more rampant than ever in this largely unregulated universe. Increased prices and globalization have introduced new levels of fraud and malfeasance into the art world--everything from "artnapping," in which an artwork is held hostage and only returned for a ransom, to forgery and tax fraud. However, the extent of the economic and cultural damage that results from criminality in the global art scene rarely comes to light. The stories of high-stakes, brazen art crimes told by art experts Stefan Koldehoff and Tobias Timm are by turns thrilling, disturbing, and unbelievable (the imagination for using art to commit crimes seems boundless). The authors also provide a well-founded analysis of what needs to change in the art market and at museums. From the authors of False Pictures, Real Money (about the Beltracchi art forgery case), Art and Crime includes a chapter on art owned by Donald Trump. It is a thoroughly researched, explosive, and highly topical book that uncovers the extraordinary and multifarious thefts of art and cultural objects around the world.
