For a “smart”, sensible translation , you should forget not the knowledge acquired at school or university, but the corrective standards. Some people want a translation with the touch of the source version, while another people feel that in a successful version we should not be able to guess the original language. We have to realize that both people have right and wrong, and that their only fault is to present requirement as an absolute truth. Teachers agree at least on this principle: “If a sentence is ambiguous, the translation must also be“. There is another critical, less easy to argue, based on an Italian phrase with particularly strong wording: “Traduttore, traditore“. This critique argues that any translation will betray the author‘s language, spirit, style … because of the choices on all sides. What to sacrifice, clarity or brevity, if the formula in the text is brief and effective, but impossible to translate into so few words with the exact meaning? One could understand this criticism that it encourages us to read “in the text.” It seems obvious that it is impossible to follow this advice into practice.

Its overarching theme is to assess the impact of CRPD Article 12 on the private law concept of legal capacity and its limitations, the significance of which carries over into the realm of penal law regulations. Its impact is analysed primarily from the legal point of view, but with due regard for its psychological and psychiatric ramifications. Recognising the importance of these disciplines is important when implementing CRPD Article 12 into domestic law, as they contribute to the determinants in creating a qualificatory legal framework for all, persons with disabilities in particular, to exercise their rights to legal capacity without let or hindrance. As active legal capacity is a notion rooted in and coming from private law, this forms the main research perspective. The first section discusses the foundational concepts constituting the CRPD Article 12 standard from domestic private law and international law perspectives. The work shows that the concepts adopted in private law interact with the protection of persons with disabilities as victims provided for in criminal law. In addition, where relevant, authors also look at public law institutions that are connected with the private law solutions. The humanitarian crisis unfolding there, or in fact the Polish government’s response to it, not only does it raisemany moral but also legal questions.The publication is the product of collaboration between two research centres operating at the Institute of Law Studies of the Polish Academy of Sciences: the Migration Law Research Centre and the Centre for Research on International Criminal Law. The authors represent various research institutions, although most of them are active members of one of the PAS centres. In this publication, the authors attempt to answer the most important of the latter. This selection of issues comes from questions and doubts appearing in press materials, and also from requests made by people helping on the border and acting as part of the Grupa Granica organisation. As you will see, the issues we address in this publication cover many different areas of law, which often overlap. They concern migration law, constitutional law, administrative law, criminal law, humanitarian law, international law and human rights law. This required assembling an expert team of authors who would be capable of providing answers to these questions – answers that are often far from obvious. We have tried to make sure that this study has mainly a practical value. For this reason, our goal was to offer concise and detailed answers to the questions and doubts which have been raised. The articles we are offering to readers are based on the academic expertise of the authors, but we have tried to use relatively clear language and not to cloak our argumentation in convoluted legalese.
