Book excerpt: Over the past several decades, civil and ethnic wars have undermined prospects for economic and political development, destabilized entire regions of the globe, and left millions dead. States, Scarcity, and Civil Strife in the Developing World argues that demographic and environmental stress--the interactions among rapid population growth, environmental degradation, inequality, and emerging scarcities of vital natural resources--represents one important source of turmoil in today's world. Kahl contends that this type of stress places enormous strains on both societies and governments in poor countries, increasing their vulnerability to armed conflict. He identifies two pathways whereby this process unfolds: state failure and state exploitation. State failure conflicts occur when population growth, environmental degradation, and resource inequality weaken the capacity, legitimacy, and cohesion of governments, thereby expanding the opportunities and incentives for rebellion and intergroup violence. State exploitation conflicts, in contrast, occur when political leaders themselves capitalize on the opportunities arising from population pressures, natural resource scarcities, and related social grievances to instigate violence that serves their parochial interests. Drawing on a wide array of social science theory, this book argues that demographically and environmentally induced conflicts are most likely to occur in countries that are deeply split along ethnic, religious, regional, or class lines, and which have highly exclusive and discriminatory political systems. The empirical portion of the book evaluates the theoretical argument through in-depth case studies of civil strife in the Philippines, Kenya, and numerous other countries. The book concludes with an analysis of the challenges demographic and environmental change will pose to international security in the decades ahead.

Thus, the authors argue, democratisation in Kenya is a laborious and non-linear process. Kenyans' recent electoral successes, the book concludes, have empowered them and reinvigorated the prospects for democracy, heralding a more autonomous and peaceful twenty-first century.

Book excerpt: Despite expectations that the celebrated second wave of constitutional democracy in the 1990s would facilitate economic development, Africa remains the continent with the highest level of poverty in the world. The fight against poverty hinges on a vibrant economy that creates jobs and income by generating enough revenue to enable the state to take pro-development measures. However, instead of the economic benefits that were supposed to accrue from the constitutional reforms of the last three decades (including entrenching a market economy), African economies remain weak, a situation that has been aggravated by the COVID-19 pandemic. By focusing on the relationship between constitutionalism and economic growth in Africa, this volume addresses five questions: (1) In the constitutional reforms of the 1990s and thereafter, did constitutions also reflect the shift towards a market economy, and if so, in what manner? (2) Given that agriculture and extractive industries are the main sources of state revenue in many African economies, how are matters of land and other natural resources dealt with constitutionally? (3) Where the market economy is captured in a constitution, what is the state's relationship to that economy: interventionist or laissez-faire, or somewhere in between? Have constitutions also established a 'social' state that provides its citizens with the basic elements of a dignified life? (4) In the process of constitution-making and implementation concerning the economy, what impact has globalization had on constitutionalism and economic growth in Africa? Book excerpt: Since the historic Nuremberg Trial of 1945 an international customary law principle has developed that commission of a core crime under international law – war crimes, genocide, crimes against humanity and aggression – should not go unpunished. History shows, that when in Africa such violations occurred, especially as a result of election disputes, national and regional actors, including the African Union, resorted to political rather than legal responses. However, when crimes against humanity were alleged to have been committed in Kenya during the 2007-2008 post-election violence, a promising road map for criminal accountability was agreed upon alongside a political solution. In the spirit of this road map, the author analyzes the post-election violence in Kenya from a legal point of view. He extensively examines legal options for domestic criminal accountability and discusses both retributive (prosecutions) and restorative justice (mainly truth commission) mechanisms, being the main legal responses to the gross violations of human rights.
