  • Author : Barnet Hartston

  • Release : 2017-11-15
  • ISBN : 1609092260
  • Pages : 263 pages

Download or read book The Trial of Gustav Graef written by Barnet Hartston and published by Cornell University Press. This book was released on 2017-11-15 with total page 263 pages. Available in PDF, EPUB and Kindle. Book excerpt: Although largely forgotten now, the 1885 trial of German artist Gustav Graef was a seminal event for those who observed it. Graef, a celebrated sixty-four-year-old portraitist, was accused of perjury and sexual impropriety with underage models. On trial alongside him was one of his former models, the twenty-one-year-old Bertha Rother, who quickly became a central figure in the affair. As the case was being heard, images of Rother, including photographic reproductions of Graef's nude paintings of her, began to flood the art shops and bookstores of Berlin and spread across Europe. Spurred by this trade in images and by sensational coverage in the press, this former prostitute was transformed into an international sex symbol and a target of both public lust and scorn. Passionate discussions of the case echoed in the press for months, and the episode lasted in public memory for far longer. The Graef trial, however, was much more than a salacious story that served as public entertainment. The case inspired fierce political debates long after a verdict was delivered, including disputes about obscenity laws, the moral degeneracy of modern art and artists, the alleged pernicious effects of Jewish influence, legal restrictions on prostitution, the causes of urban criminality, the impact of sensationalized press coverage, and the requirements of bourgeois masculine honor. Above all, the case unleashed withering public criticism of a criminal justice system that many Germans agreed had become entirely dysfunctional. The story of the Graef trial offers a unique perspective on a German Empire that was at the height of its power, yet riven with deep political, social, and cultural divisions. This compelling study will appeal to historians and students of modern German and European history, as well as those interested in obscenity law and class and gender relations in nineteenth-century Europe.

Book Baseball Meets the Law

Download or read book Baseball Meets the Law written by Ed Edmonds and published by McFarland. This book was released on 2017-03-04 with total page 336 pages. Available in PDF, EPUB and Kindle. Book excerpt: Baseball and law have intersected since the primordial days. In 1791, a Pittsfield, Massachusetts, ordinance prohibited ball playing near the town's meeting house. Ball games on Sundays were barred by a Pennsylvania statute in 1794. In 2015, a federal court held that baseball's exemption from antitrust laws applied to franchise relocations. Another court overturned the conviction of Barry Bonds for obstruction of justice. A third denied a request by rooftop entrepreneurs to enjoin the construction of a massive video screen at Wrigley Field. This exhaustive chronology traces the effects the law has had on the national pastime, both pro and con, on and off the field, from the use of copyright to protect not only equipment but also "Take Me Out to the Ball Game" to frequent litigation between players and owners over contracts and the reserve clause. The stories of lawyers like Kenesaw Mountain Landis and Branch Rickey are entertainingly instructive.

Book Hitler s Prisons Legal Terror in Nazi Germany

Download or read book Hitler s Prisons Legal Terror in Nazi Germany written by Nikolaus Wachsmann and published by Yale University Press. This book was released on 2015-05-26 with total page 556 pages. Available in PDF, EPUB and Kindle. Book excerpt: State prisons played an indispensable part in the terror of the Third Reich, incarcerating many hundreds of thousands of men and women during the Nazi era. This important book illuminates the previously unknown world of Nazi prisons, their victims, and the judicial and penal officials who built and operated this system of brutal legal terror. Nikolaus Wachsmann describes the operation and function of legal terror in the Third Reich and brings Nazi prisons to life through the harrowing stories of individual inmates. Drawing on a vast array of archival materials, he traces the series of changes in prison policies and practice that led eventually to racial terror, brutal violence, slave labor, starvation, and mass killings. Wachsmann demonstrates that "ordinary" legal officials were ready collaborators who helped to turn courts and prisons into key components in the Nazi web of terror. And he concludes with a discussion of the whitewash of the Nazi legal system in postwar West Germany.

Book The Supreme Court versus Congress

Download or read book The Supreme Court versus Congress written by William B. Glidden and published by Bloomsbury Publishing USA. This book was released on 2015-03-17 with total page 264 pages. Available in PDF, EPUB and Kindle. Book excerpt: A comprehensive and focused review of all of the Supreme Court's overturns of Congress on constitutional grounds from 1789 to the present suited to college-level political science and constitutional law courses as well as law school students. The always-controversial practice of judicial review of Congress is not prescribed in the Constitution, but is arguably a valid way to protect the rights of individuals or guard against unfair rule by the majority. This book offers a historical review and indictment of the Supreme Court's overruling of Congress, ultimately taking a position that this has been more detrimental than beneficial to the democratic process in the United States, and that in the aggregate rights of individuals and minorities would have been better served if the relevant laws of Congress had been enforced rather than struck down by the Court. Written by an author who is a historian and a lawyer, the book covers all Supreme Court overrides of Congress through 2014, including major historical turning points in Supreme Court legislation and such recent and relevant topics as the Affordable Care Act, limits on contributions to political candidates and campaigns from wealthy individuals, and the Defense of Marriage Act. The discussions of specific cases are made in relevant context and focus on "big picture" themes and concepts without skipping key details, making this a useful volume for law and university level students while also being accessible to general readers.
