At the request of INL, the National Academies of Sciences, Engineering, and Medicine assembled the Committee on Evidence to Advance Reform in the Global Security and Justice Sectors to review the available research evidence on police and policing practices, with emphasis on how police reform can promote the rule of law and protect the public. The 5 consensus studies that are part of this project provide evidence-driven policy and research recommendations for key stakeholders with the goal of informing capacity-building activities. This report is a compilation of those 5 studies.

Today's fragile environments feature a host of postconflict and postauthoritarian states and transitioning and new democracies that have at least one critical thing in common: Their security sectors are dysfunctional. Why these states cannot fulfill their most basic function-the protection of the population and their government-varies widely, but the underlying reason is the same. The security sector does not function because security sector institutions and forces are absent, ineffective, predatory, or illegitimate. In place of large, boots-on-the-ground interventions relying on expensive train and equip programs with only fleeting impact, Washington needs a new approach for engaging in fragile environments and a policy for prioritizing where it engages and for what purpose. The volume offers case studies to exemplify the context in which a new U.S. approach might be warranted, discusses other countries' experiences with security sector reform policies and examines how the United States should design and implement a security sector reform policy. Book excerpt: Security sector reform (SSR) and transitional justice processes often occur alongside each other in societies emerging from conflict or authoritarian rule, involve many of the same actors, are supported by some of the same partner countries and impact on each other. Yet the relationship between SSR and transitional justice, or “dealing with the past” (DwP) as it is also called, remains underexplored and is often marked by ignorance and resistance. While SSR and transitional justice processes can get into each other’s way, this paper argues that SSR and DwP are intrinsically linked and can complement each other. SSR can make for better transitional justice and vice versa. Transitional justice needs SSR to prevent a recurrence of abuses, an essential element of justice. SSR can learn from transitional justice not only that it is better to deal with rather than ignore an abusive past but also how to address an abusive legacy in the security sector. The validity of these assumptions is tested in two case studies: the police reform process in Bosnia and Herzegovina after 1995 and the SSR process in Nepal after 2006.

SSR theory and practice are criticized for being overly focused on traditional conflict and post-conflict settings and for being unable to adjust to unconventional settings marked by chronic crime and terrorism. SSR tends to be disproportionately focused on national institutions and less amenable to engaging at the subnational scale. Drawing on the experiences of so-called ‘citizen security’ measures in cities across Latin America and the Caribbean, this paper offers some opportunities for renewing and revitalizing SSR. The emphasis of citizen security interventions on multiple forms of insecurity, data-driven and evidence-informed prevention, the promotion of social cohesion and efficacy and designing crime prevention into the social and built environment are all insights that can positively reinforce comprehensive SSR measures in the 21st century.

Book excerpt: Placed within the context of the past decade's war on terror and emergent Latino migrant movement, Reform without Justice addresses the issue of state violence against migrants in the United States. It questions what forces are driving draconian migration control policies and why it is that, despite its success in mobilizing millions, the Latino migrant movement and its allies have not been able to more successfully defend the rights of migrants. Gonzales argues that the contemporary Latino migrant movement and its allies face a dynamic form of political power that he terms "anti-migrant hegemony". This type of political power is exerted in multiple sites of power from Congress, to think tanks, talk shows and local government institutions, through which a rhetorically race neutral and common sense public policy discourse is deployed to criminalize migrants. Most insidiously anti-migrant hegemony allows for large sectors of "pro-immigrant" groups to concede to coercive immigration enforcement measures such as a militarized border wall and the expansion of immigration policing in local communities in exchange for so-called Comprehensive Immigration Reform. Given this reality, Gonzales sustains that most efforts to advance immigration reform will fail to provide justice for migrants. This is because proposed reform measures ignore the neoliberal policies driving migration and reinforce the structures of state violence used against migrants to the detriment of democracy for all. Reform without Justice concludes by discussing how Latino migrant activists - especially youth - and their allies can change this reality and help democratize the United States.

Book excerpt: Adolescence is a distinct, yet transient, period of development between childhood and adulthood characterized by increased experimentation and risk-taking, a tendency to discount long-term consequences, and heightened sensitivity to peers and other social influences. A key function of adolescence is developing an integrated sense of self, including individualization, separation from parents, and personal identity. Experimentation and novelty-seeking behavior, such as alcohol and drug use, unsafe sex, and reckless driving, are thought to serve a number of adaptive functions despite their risks. Research indicates that for most youth, the period of risky experimentation does not extend beyond adolescence, ceasing as identity becomes settled with maturity. Much adolescent involvement in criminal activity is part of the normal developmental process of identity formation and most adolescents will mature out of these tendencies. Evidence of significant changes in brain structure and function during adolescence strongly suggests that these cognitive tendencies characteristic of adolescents are associated with biological immaturity of the brain and with an imbalance among developing brain systems. This imbalance model implies dual systems: one involved in cognitive and behavioral control and one involved in socio-emotional processes. Accordingly adolescents lack mature capacity for self-regulations because the brain system that influences pleasure-seeking and emotional reactivity develops more rapidly than the brain system that supports self-control. This knowledge of adolescent development has underscored important differences between adults and adolescents with direct bearing on the design and operation of the justice system, raising doubts about the core assumptions driving the criminalization of juvenile justice policy in the late decades of the 20th century. It was in this context that the Office of Juvenile Justice and Delinquency Prevention (OJJDP) asked the National Research Council to convene a committee to conduct a study of juvenile justice reform. The goal of Reforming Juvenile Justice: A Developmental Approach was to review recent advances in behavioral and neuroscience research and draw out the implications of this knowledge for juvenile justice reform, to assess the new generation of reform activities occurring in the United States, and to assess the performance of OJJDP in carrying out its statutory mission as well as its potential role in supporting scientifically based reform efforts.

Book excerpt: There is broad recognition, across the political spectrum and in both 'northern' and 'southern' countries, that justice reform, and more generally the promotion of the 'rule of law', are central to development policy, particularly in conflict-affected, fragile and violent contexts. More recently an increased focus on global security and the interaction between security and development as put a renewed emphasis on such efforts. However, while legal, regulatory and 'justice' institutions are now seen as key part of the 'solution' to problems of conflict, fragility and development, this recognition is not matched by a correspondingly clear sense of what should be done, how it should be done, by whom, in what order, or how 'success' may be determined. There often tends to be a clear misunderstanding of both the nature of the problem and (thus) of the solution. In this paper, the author seek to provide some insight into these questions and sketch out a practical conception of effective justice reform in situations of conflict and fragility that may provide the basis for effective programming.
