On the contrary, national identity rhetoric seems on the rise, not only in politics but also in legal discourse. Lately we have seen a rise in the number of Member States invoking their national identity in an attempt to justify a derogation from a requirement imposed on them by a Treaty article or an EU legislative act, or to legitimize a particular national reading of such an EU norm. Despite this, the European Court of Justice (ECJ) has yet to develop a coherent approach to such arguments, or express a vision of the role national identity should play in EU law. Elke Cloots undertakes this task by providing a principled and coherent scheme for the adjudication of disputes involving claims based on the national identity of a Member State. Should arguments involving national identity be legally relevant? If yes, how should the ECJ approach such identity-related interests? Cloots crafts a normative framework to assist the ECJ in striking the right balance between European integration and respect for the identity concerns at issue. The book combines rigorous theoretical inquiry with thorough analysis of the European Treaties and case law, with particular attention paid to litigation involving domestic measures concerning the national system of government, constitutional rights protections, and language policy. The aim is to explore to what extent existing legal mechanisms permit a flexible engagement with, and accommodation of, the aspirations of national and ethnic groups. It would appear that a heightened level of fluidity in the interaction and exchange of normative standards now exists in the relationship between international and domestic law as both types of system confront the challenge which national identity continues to constitute. As this process marks a renewed preparedness on the part of legal systems to expand imaginatively to meet current problems it is hoped that this collection will highlight opportunities for an ongoing process of development in this complex and troubled area.

The policy transformations under its leader Recep Tayyip Erdogan do not align with existing explanations based on security, economics, institutions, or identity. In Identity Politics Inside Out, Lisel Hintz teases out the complex link between identity politics and foreign policy using an in-depth study of Turkey. Rather than treating national identity as cause or consequence of a state's foreign policy, she repositions foreign policy as an arena in which contestation among competing proposals for national identity takes place. Drawing from a broad array of sources in popular culture, social media, interviews, surveys, and archives, she identifies competing visions of Turkish identity and theorizes when and how internal identity politics becomes externalized. Hintz examines the establishment of Republican Nationalism in the wake of imperial collapse and examines failed attempts made by those challenging its Western-oriented, anti-ethnic, secularist values with alternative understandings of Turkishness. She further demonstrates how the Ottoman Islamist AKP used the European Union accession process to weaken Republican Nationalist obstacles in Turkey, thereby opening up space for Islam in the domestic sphere and a foreign policy targeted at achieving leadership in the Middle East. By showing how the "inside out" spillover of national identity debates can reshape foreign policy, Identity Politics Inside Out fills a major gap in existing scholarship by closing the identity-foreign policy circle.

Questions of identity--who should be counted as a "true member" of a society and who deserves assistance from the government--have displaced other social and economic issues across nations in many countries. This study considers the role of identity theoretically and in the United States, the United Kingdom, France, Austria, Germany, Sweden, Hungary, Poland, Israel, and Taiwan. Identity varies over time and over countries. Some such as Sweden have a more "inclusive" sense of identity--one does not need to be born in the country or have ancestry to be considered a "true Swede." Other countries, such as Austria, France, Hungary, Poland, Israel, and Taiwan, have a more "exclusive" notion of identity--where one was born and a common heritage (race, religion, ethnicity) are seen as essential for seeing others as "true" members of society. "Outsiders" are viewed negatively, often as threatening a national culture and not deserving of government assistance. In the United States, the United Kingdom, and France, the major political parties take opposing positions on identity. In the United States and the United Kingdom, issues of identity have become highly correlated (polarized) with social and economic issues. In the former Communist countries of Hungary and Poland, the dominant parties have taken nationalist positions on identity but favor generous welfare policies for people of their own background. In Israel and Taiwan, social and economic issues have become less important than nationalism.

As transactions once based on personal relationships are increasingly automated, it is inevitable that our traditional concept of identity will need to be redefined. This book examines the functions and legal nature of an individual's digital identity in the context of a national identity scheme. The analysis and findings are relevant to the one proposed for the United Kingdom, to other countries which have similar schemes, and to countries like Australia which are likely to establish such a scheme in the near future. Under a national identity scheme, being asked to provide ID will become as commonplace as being asked one's name, and the concept of identity will become embedded in processes essential to the national economic and social order. The analysis reveals the emergence of a new legal concept of identity. This emergent concept and the associated individual rights, including the right to identity, potentially change the legal and commercial landscape. The author examines the implications for individuals, businesses and government against a background of identity crime.
