Book excerpt: Um justo processo é a espinha dorsal que movimenta toda ideia mais hodierna de acesso aos canais da jurisdição, consagrando, portanto, as condições insupríveis e mínimas sem as quais não seria possível aplicar o direito material com justiça. Diante do quadro gizado, o controle jurisdicional deve ser analisado em função das garantias fundamentais e dos princípios que são assegurados ao indivíduo, bem como à coletividade. Destarte, a tutela jurisdicional deve ser capaz de resolver os conflitos de modo adequado, como também correspondendo aos valores primordiais do Estado Democrático de Direito. Urge trazer à baila que não basta que a máquina judicial seja efetiva, exige-se que as demandas sejam atendidas em tempo razoável, de modo universal, alcançando o maior número possível de situações conflituosas. Mais do que isso, cabe destacar que o acesso à justiça é um direito fundamental expresso pela Carta Magna de 1988, acolhido em seu artigo 5º, inciso LXXIV, que assegura a todos a assistência judiciária. Neste sentido, o Estado é responsável pela efetivação deste direito. Tendo em vista que por meio dele há abertura para o exercício dos demais direitos. Calha trazer à tona que tal acesso não se configura apenas pelo direito público subjetivo a propositura de uma ação, mas também por vedar que o legislador edite uma lei que exclua o Poder Judiciário da apreciação de todo e qualquer direito que venha ser lesionado ou ameaçado. Os Juizados Especiais são vislumbrados na terceira onda renovatória cappelletiana e foram instituídos no território brasileiro na década de 1980, inspirados pela experiência já consolidada no Direito norte-americano das Small Claims Courts. Urge ressaltar que, conforme evidenciado em momento anterior, foram criados e disciplinados pela Lei 9.099, são órgãos da Justiça Ordinária, com competência para a conciliação, o julgamento e a execução das causas de menor complexidade. Possuem total autonomia funcional. Deste modo, o movimento de acesso à Justiça abarca não somente a possibilidade de um Judiciário acessível a todos e a consequente obtenção de resultados justos, tal como a expansão da tutela e salvaguarda da tutela a direitos emergentes. Ora, diante de tal cenário, denota-se os Juizados Especiais têm seu âmago de criação na descentralização da Justiça. Com isso, atualmente, encontram-se em vigor a Lei n. 9.099/1995, dos Juizados Especiais da Justiça Estadual; a Lei n. 10.259/2001, dos Juizados Especiais da Justiça Federal; a Lei n.12.153/2009, dos Juizados Especiais da Fazenda Pública nos estados, Distrito Federal, Territórios e municípios e o Código de Processo Civil. Através da ampliação da Lei 9.099/1995 substituindo a Lei 7.244/1984 dos Juizados Especiais de Pequenas Causas para os Juizados Cíveis e Criminais, os doutrinadores concluem que os juizados especiais cíveis tratam de um sistema ágil e simplificado de distribuição da justiça pelo Estado, podendo ser considerado um instrumento de acesso à justiça ocasionando uma tutela efetiva jurisdicional. Ora, há de se falar ainda que os Juizados possuem um caminho voltado para a solução conciliatória. Ao lado disso, Cappelletti trabalha com a questão da justiça coexistencial, que, em outras palavras, é a busca por soluções consensuais, para que possa pôr fim à animosidade entre as partes. Certamente. a criação dos Juizados Especiais contribuiu para a promoção de uma cultura voltada à paz, visando precipuamente à composição amigável de litígios. Todavia, faz-se necessário refletir sobre a prática cotidiana do processamento de suas demandas, buscando neste trâmite processual a maior facilidade de acesso à justiça, principalmente as classes mais abastadas que diariamente chegam sem esperança às portas do Poder Judiciário, pois temem pela condição de hipossuficiência. Entretanto como dito o processamento dos Juizados Especiais tem seu foque na celeridade e efetividade das lides ocasionando resoluções de tutelas jurídicas efetivas. A partir deste debate, algumas reflexões são colhidas, sob a forma dos capítulos que constituem esta proposta, decorrentes do projeto de iniciação científica intitulado “Pelas Mãos de Alice”, de Boaventura de Souza Santos, em um viés regional: entraves e obstáculos ao acesso ao Poder Judiciário no município de Bom Jesus do Itabapoana-RJ”, e que permite ao leitor pensar a temática. Sendo assim, convidamos a todos a uma leitura prazerosa acerca do material selecionado.
