There is an increasing recognition of the need to integrate and improve coordination of regulatory activities among national and international bodies for better protection of human, animal and plant life and health without creating unnecessary barriers to trade. In addition, catastrophic outbreaks of food-borne disease have sparked increasing attention to the regulatory frameworks for food safety and food trade in the global arena. These developments have given rise to new legislative needs. National regulatory frameworks have to be adjusted to meet international and regional obligations, while the distribution of responsibilities for the food sector requires rigorous review. The present text draws on FAO's experience in providing technical assistance to governments developing new food laws and regulations, setting out and examining the many elements of the national system which should be taken into account in a comprehensive review of national regulatory frameworks for food. Towards that end, the text offers concrete recommendations for the preparation of a basic national food law, including three variants of a new model food law.

Book excerpt: In 2014, the authors of this article published the first analysis of the development and history of the relatively new academic field of Food Law & Policy (“FL&P”). As we defined the field in that article, FL&P “is the study of the basis and impact of those laws and regulations that govern the food and beverages we grow, raise, produce, transport, buy, sell, distribute, share, cook, eat, and drink.” FL&P was born out of two pre-existing fields: Food & Drug Law and Agricultural Law, but it differs from its parent fields in that it explores legal and policy issues regulation of food by various agencies, at all levels of government, and across the range of agricultural, health, labor, economic, environmental, and other issues that intersect with food. This broader analysis of the food system3 had not been part of the legal academy prior to 2004. For our 2014 article, we developed ten criteria to measure the breadth and depth of a legal-academic field. According to our analysis, FL&P met seven of the ten criteria in 2014, and was firmly entrenched in terms of course offerings, clinical projects, and scholarly writing. Now, four years later, the field meets all ten of our criteria, and its continued growth has solidified its place in legal academia. The present article endeavors to assess and discuss this growth by reviewing the same ten criteria of a legal-academic field and tracking developments in the four years since we collected our initial data. As the article details, FL&P's newfound strength within each of our ten criteria demonstrates the field has grown strong roots.

This is only natural because both intend to control that food products placed in the market are safe and respond to a certain standard of quality. In their present form, both are relatively new legal disciplines, evolving and expanding very rapidly and a great number of new and transcendental regulations (and an increasing number of compulsory private rules) are being enacted to respond to new realities. One of these new realities is the legal protection of quality in food. Once almost exclusively applied to a limited number of traditional well-known products and now extended to many products covered by designations of origin or geographical indications. Another area is food safety, a major concern of the legislator. Food alerts, recalls and withdrawals have been carefully regulated to guarantee a rapid and efficient reaction, but these legal mechanisms appear to be less well-designed when dealing with the unwanted consequences of unjustified alerts. A third topic is food prices and trading conditions, an area that cannot always be completely left to unregulated market-forces due to the special nature of the product involved. The above issues are analysed by several experts from different legal backgrounds and countries, a varied approach adequate to the hybrid nature of food law.
