Book excerpt: Five Pentateuchal texts (Lev 24:10-23; Num 9:6-14; Num 15:32-36; Num 27:1-11; Num 36:1-12) offer unique visions of the elaboration of law in Israel's formative past. In response to individual legal cases, Yahweh enacts impersonal and general statutes reminiscent of biblical and ancient Near Eastern law collections. From the perspective of comparative law, Dylan R. Johnson proposes a new understanding of these texts as biblical rescripts: a legislative technique that enabled sovereigns to enact general laws on the basis of particular legal cases. Typological parallels drawn from cuneiform and Roman law illustrate the complex ideology informing the content and the form of these five cases. The author explores how latent conceptions of law, justice, and legislative sovereignty shaped these texts, and how the Priestly vision of law interacted with and transformed earlier legal traditions.

Uber den Umweg der Sihon-Tradition haben die biblischen Autoren Moab aus dem nordlichen in den sudlichen Landesteil verlagert. Das eigentliche Kernland Moabs war aber zu allen Zeiten nordlich des Arnon. Schliesslich werden die archaologischen Daten fur eine Rekonstruktion der Geschichte Moabs im 1. Jahrtausend v.Chr. herangezogen.Der Durchgang durch die Quellen zeigt, dass ab dem 9. Jahrhundert v. Chr. im nordlichen Moab nationalstaatliche Tendenzen auszumachen sind. Die verschiedenen Ethnien im Gebiet von Moab wurden in der Folgezeit geeint. Archaologisch zeigt sich, dass die Besiedlung des sudlichen Moabs vermutlich von einer starken Zentralmacht im Norden organisiert wurde. Erst nach dem Verlust der Nationalstaatlichkeit erodiert auch das Zusammengehorigkeitsgefuhl der Bewohner. Eine staatlich verfasste Gesellschaft hat es ab der persischen Zeit in Moab fur lange Zeit nicht mehr gegeben.

Book excerpt: The Body As Property indicates that physical disfigurement functioned in biblical law to verify legal property acquisition, when changes in the status of dependents were formalized. It is based on the reality the cuneiform script, in particular, was developed in Sumer and Mesopotamia for the purpose of record keeping: to provide legal proof of ownership where the inscription of a tablet evidenced the sale, or transfer, of property. Legitimate property acquisition was as important in biblical law, where physical disfigurements marked dependents, in a similar way that the veil or the head covering identified a wife or concubine in ancient Assyrian and Judean societies. This is primarily substantiated in the accounts of prescriptive disfigurements: namely circumcision and the piercing of a slave's ear, both of which were required only when a son, or slave, was acquired permanently. It is further argued that legal entitlement was relevant also to the punitive disfigurements recorded in Exodus 21:22-24, and Deuteronomy 25:11-12, where the physical violation of women was of concern solely as an infringement of male property rights.
