Book excerpt: For nearly forty years, following the collapse of Indonesia's parliamentary system, Indonesia's once independent legal institutions were transformed into dedicated instruments of a powerful elite and allowed to sink into a deep mire of corruption and malfeasance. Legal process was devastated far beyond the capacity of any simple effort at reconstruction by post-Suharto governments. Indonesia's problems in this respect surpass those of other countries in the region compelled by economic crisis to re-examine institutional structures. The works reprinted in this collection constitute a case study over time of legal decay and the rise of reform interests in one of the most complex countries in the world. Written during a period of more than thirty years, beginning in the early 1960s, the essays trace several themes in the legal history of modern Indonesia. They make clear, however, that legal history is seldom that alone, but rather, like law itself, is largely derivative, fundamentally imbedded in the interest, ideas, purposes, and contentions of local political, social, and economic power.

Book excerpt: Between 1895 and 1945, Japan was heavily engaged in other parts of Asia, first in neighbouring Korea and northeast Asia, later in southern China and Southeast Asia. During this period Japanese ideas on the nature of national identities in Asia changed dramatically. At first Japan discounted the significance of nationalism, but in time Japanese authorities came to see Asian nationalisms as potential allies, especially if they could be shaped to follow Japanese patterns. At the same time, the ways in which other Asians thought of Japan also changed. Initially many Asians saw Japan as a useful but distant model, but with the rise of Japanese political power, this distant admiration turned into both cooperation and resistance. This volume includes chapters on India, Tibet, Siberia, Mongolia, Korea, Manchukuo, China, Taiwan, Vietnam, Thailand, the Philippines and Indonesia.

In 1947, none of the three major race of Malaya - Malays, Chinese, and Indians - regarded themselves as pan-ethnic "e;Malayans"e; with common duties and problems. With the occupation forcibly cut them off from China, Chinese residents began to look inwards towards Malaya and stake political claims, leading inevitably to a political contest with the Malays. As the country advanced towards nationhood and self-government, there was tension between traditional loyalties to the Malay rulers and the states, or to ancestral homelands elsewhere, and the need to cultivate an enduring loyalty to Malaya on the part of those who would make their home there in future. As Japanese forces withdrew from the countryside, the Chinese guerrillas of the communist-led resistance movement, the Malayan People's Anti-Japanese Army (MPAJA), emerged from the jungle and took control of some 70 per cent of the country's smaller towns and villages, seriously alarming the Malay population. When the British Military Administration sought to regain control of these liberated areas, the ensuing conflict set the tone for future political conflicts and marked a crucial stage in the history of Malaya. Based on extensive archival research, Red Star Over Malaya provides a riveting account of the way the Japanese occupation reshaped colonial Malaya, and of the tension-filled months that followed Japan's surrender. Transnational activist movements have sought to recognize and redress survivors of this World War II-era system, euphemistically known as “comfort women,” for decades, with a major wave beginning in the 1990s. However, Indonesian survivors, and even the system’s history in Indonesia to begin with, have largely been sidelined, even within the country itself. Here, Katharine E. McGregor not only untangles the history of the system during the war, but also unpacks the context surrounding the slow and faltering efforts to address it. With careful attention to the historical, social, and political conditions surrounding sexual violence in Indonesia, supported by exhaustive research and archival diligence, she uncovers a critical piece of Indonesian history and the ongoing efforts to bring it to the public eye. Critically, she establishes that the transnational part of activism surrounding victims of the system is both necessary and fraught, a complexity of geopolitics and international relationships on one hand and a question of personal networks, linguistic differences, and cultural challenges on the other.

The study looks into the structural and ideological state formation during the so-called Liberal Democracy (1950-1957) and Sukarno’s Guided Democracy (1957-1965). In particular, it analyses how the international technical aid network and the dominant managerialist ideology of the period legitimized a new managerial elite. The book discusses the development of managerial education in the civil and military sectors in Indonesia. The study gives a strongly backed argument that Sukarno’s constitutional reform during the Guided Democracy period inadvertently provided a strong managerial blueprint for the New Order developmentalist state.

Book excerpt: In northern Sumatra, as in Malaya, colonial rule embraced an extravagant array of sultans, rajas, datuks and uleebalangs. In Malaya the traditional Malay elite served as a barrier to evolutionary change and survived the transition to independence, but in Sumatra a wave of violence and killing wiped out the traditional elite in 1945-46. Anthony Reid's The Blood of the People, now available in a new edition, explores the circumstances of Sumatra's sharp break with the past during what has been labelled its "social revolution." The events in northern Sumatra were among the most dramatic episodes of Indonesia's national revolution, and brought about more profound changes even than in Java, from where the revolution is normally viewed. Some ethnic groups saw the revolution as a popular, peasant-supported movement that liberated them from foreign rule. Others, though, felt victimised by a radical, levelling agenda imposed by outsiders. Java, with a relatively homogeneous population, passed through the revolution without significant social change. The ethnic complexity of Sumatra, in contrast, meant that the revolution demanded and altogether new "Indonesian" identity to override the competing ethnic categories of the past.
