The transition to a new regime has been difficult for many states, most notably Japan, whose rights to use the entire ocean were well protected by the traditional regime. Japan’s response to the need to develop a modern ocean policy— to adapt to the emerging ocean management regime—is the subject of this multiauthor volume. U.S. and Japanese scholars look at what Japan is doing, how, and with what results. They first assess general trends in ocean management, then examine the role of Japan in the international political economy of the oceans, and finally look at Japan’s ocean policy in various sectors: shipbuilding, fisheries, mineral resources, offshore petroleum, and nuclear power generation. Given Japan’s importance in ocean affairs, the authors point out that the lessons that can be learned from its experience are of prime international importance.

The seas have long played a vital role for the Japanese, helping to support the economic and social life of a nation that possesses few resources and little arable land, and sustain a population that has nearly tripled in the last century. Fish are a distinctive feature of the Japanese diet, constituting nearly half of all animal protein consumed – the highest rate in the world. The industry itself has provided an impetus for coastal community growth and national economic development over the past century, while fisheries have worked their way into Japanese culture and customs, serving as a dominant symbol in traditional arts and folklore. This book explores the overarching rationale that motivated Japanese international fisheries policy throughout the post-war period until today, highlighting the importance of international fisheries to Japan and the stature this resource has occupied as a national interest. It provides a comparative view of Japanese foreign policy at various ocean conferences, treaty negotiations, bilateral diplomatic initiatives and other maritime relations that constitute ocean policy over half a century, and investigates the domestic constituents of national policy. Roger Smith argues that the rationale for international fisheries policy may be best viewed as deriving from Japan’s unique defence strategy for its national interests: comprehensive security. Encompassing non-military elements and most importantly defence of economic interests, Japan’s international fisheries policy provides an interesting case study of how comprehensive security is conceptualised and carried out. Book excerpt: The Subversive Activities Prevention Law (SAPL) was the last major controversial law to be drafted at the end of the Allied Occupation of Japan (1945-1952) which was managed and controlled by General Headquarters (GHQ) under U.S. General MacArthur and was enacted into law after Japan had regained its formal independence in 1952. Soon after the Occupation began, prewar Japanese internal security laws were ordered abolished by the Occupation. Now that Japan would be re-gaining its independence in 1952, there was urgency to creating a new integrated national internal security law to fill the vacuum created by the Occupation, 1945-1952. The Subversive Activities Prevention Law was to be the centerpiece for maintaining internal security in the new independent Japan. It turned out to be an extremely controversial law that was vociferously opposed by the political opposition in and out of the Diet in light of the prewar history, surrounding how such internal security laws were implemented by the state security apparatus. The demonstrations in 1951-52 against the proposed law, organized by the labor unions, were the largest, loudest and most determined since the end of the war. This publication is the first analysis in English on how this law was drafted and debated, supported and opposed, using the 20+ drafts of the law, and the subsequent deliberations concerning the proposed law in the Houses of Representatives and Councillors. A short epilogue - since over 50 years have elapsed since the law was initially enacted in 1952 - analyzes the implementation of the law during these years. "The Subversive Activities Prevention Law of Japan, Its Creation, 1951-1952" will be of particular interest to those studying the Allied Occupation of Japan, the Japanese political and legislative process and its internal security laws.
