More than 125 further prisoners were killed in the custody of the state: kidnapped and shot; tied to landmines and blown up; shot after surrender, ‘trying to escape’ or even killed under interrogation. These men were killed because they were anti-treaty fighters or because they were suspected of involvement or sympathy with the anti-treaty cause. In the heat of civil war, the inquest system became part of the battle ground where the emerging state connived at the suppression of evidence and turned a blind eye to perjury and cover-up. At the end of the Civil War, there were 3,000 dead, over 10,000 wounded, 13,000 interned, and many more forced into migration. And in this period of great crisis, the bedrock of law itself had been shattered. This dark, secret corner of Irish history, whose bitter legacy affects society to this day, is uncompromisingly exposed in The Irish Civil War: Law, Execution and Atrocity.

Using original archival material, this book sheds light on the various social, legal and political contexts in which the death penalty operated and was discussed. In Ireland the death penalty served a dual function: as an instrument of punishment in the civilian criminal justice system, and as a weapon to combat periodic threats to the security of the state posed by the Irish Republican Army (IRA). Through close examination of cases dealt with in the ordinary criminal courts, this study elucidates ideas of class, gender, community and sanity and explores their impact on the administration of justice. The application of the death penalty also had a strong political dimension, most evident in the enactment of emergency legislation and the setting up of military courts specifically aimed at the IRA. Book excerpt: After the Rebellion, came the trials. 3,226 men and women were rounded up and brought to Richmond Barracks in Dublin, where they were screened for trial, deportation or release. In the following three weeks of May 1916 nearly 2,000 men and women were deported and interned. 160 prisoners were tried by Field General Courts Martial. These trials were held in camera - no press or public were admitted. None of the prisoners were legally represented or permitted to give sworn evidence in their own defence. Most trials lasted about 20 minutes or less. 90 death sentences were passed and 15 were carried out. This book provides a powerful analysis of an uncomfortable moment in history when the rule of law gave way to political imperatives. The trials and executions took place while the outcome of the Great War hung in the balance. The government judged that publication of the trial records would damage army recruitment and the war effort, so the trial records were suppressed and most were thought to have been destroyed. But since the turn of the century more and more trial records have surfaced, casting dramatic new insights into what took place. This book, the companion to The Trial of Civilians by Military Courts: Ireland 1921, is a fascinating and comprehensive study of the trials which proved to be a pivotal event in Anglo-Irish history.
