In what may be unique, it combines a generalized account of various claims and possibilities with an examination of major domains of American constitutional law. This demonstrates convincingly that the book's major themes not only can be supported by individual examples, but are undeniably in accord with the continuing practice of the United States Supreme Court over time, and cannot be dismissed as misguided. The book's central thesis is that strategies of constitutional interpretation cannot be simple, that judges must take account of multiple factors not systematically reducible to any clear ordering. For any constitution that lasts over centuries and is hard to amend, original understanding cannot be completely determinative. To discern what that is, both how informed readers grasped a provision and what were the enactors' aims matter. Indeed, distinguishing these is usually extremely difficult, and often neither is really discernible. As time passes what modern citizens understand becomes important, diminishing the significance of original understanding. Simple versions of textualist originalism neither reflect what has taken place nor is really supportable. The focus on specific provisions shows, among other things, the obstacles to discerning original understanding, and why the original sense of proper interpretation should itself carry importance. For applying the Bill of Rights to states, conceptions conceived when the Fourteenth Amendment was adopted should take priority over those in 1791. But practically, for courts, to interpret provisions differently for the federal and state governments would be highly unwise. The scope of various provisions, such as those regarding free speech and cruel and unusual punishment, have expanded hugely since both 1791 and 1865. And questions such as how much deference judges should accord the political branches depend greatly on what provisions and issues are involved. Even with respect to single provisions, such as the Free Speech Clause, interpretive approaches have sensibly varied, greatly depending on the more particular subjects involved. How much deference judges should accord political actors also depends critically on the kind of issue involved.

The book examines ways of understanding the distribution of responsibility of content and the progression of talk in interpreter-mediated institutional face-to-face encounters in the community interpreting context. Bringing attention to discursive and social practices prominent in modern society but largely unexplored in the existing literature, the book describes and explains real-life interpreter-mediated conversations as documented in various public institutions, such as hospitals and police stations. The data show that the interpreter's prescribed role as a non-participating, non-person does not -and cannot - always hold true. The book convincingly argues that this in one sense exceptional form of communication can be used as a magnifying glass in the grounded study of face-to-face institutional interaction more generally. Cecilia Wadensjö explains and applies a Bakhtinian dialogic theory of language and mind, and offers an alternative understanding of the interpreter's task, as one consisting of translating and co-ordinating, and of the interpreter as an engaged actor solving problems of translatability and problems of mutual understanding in situated social interactions. Teachers and students of translation and interpretation studies, including sign language interpreting, applied linguistics and sociolinguistics will welcome this text. In this provocative book, Elyn R. Saks focuses closely on what hermeneutic psychoanalysis is and how the approaches of hermeneutic psychoanalysts differ. She finds that although these psychoanalysts use the same words, concepts, images, and analogies, they hold to at least five different positions on the truth of psychoanalytic interpretations. Saks locates within these five models the thought of such prominent analysts as Roy Schafer, Donald Spence, and George Klein. Then, approaching each model from the patient’s point of view, the author reaches important conclusions about treatments that patients not only will-but should-reject.If patients understood the true nature of the various models of hermeneutic psychoanalysis, Saks argues, they would spurn the story model, which asks patients to believe interpretations that do not purport to be true; that is, the psychoanalyst simply tells stories that give meaning to patients’ lives, the truth of which is not considered relevant. And patients would question the metaphor and the interpretations-as-literary-criticism models, which propose views of psychoanalysis that may be unsatisfying. In addition to discussing which hermeneutic models of treatment are plausible, Saks discusses the nature of metaphorical truth. She arrives at some penetrating insights into the theory of psychoanalysis itself.

Mental reflexivity, or metamentation—a mind thinking about its own thoughts—underpins reflexive consciousness, deliberation, self-evaluation, moral judgment, the ability to think ahead, and much more. Yet relatively little in philosophy or psychology has been written about what metamentation actually is, or about why and how it came about. In this book, Radu Bogdan proposes that humans think reflexively because they interpret each other's minds in social contexts of cooperation, communication, education, politics, and so forth. As naive psychology, interpretation was naturally selected among primates as a battery of practical skills that preceded language and advanced thinking. Metamentation began as interpretation mentally rehearsed: through mental sharing of attitudes and information about items of common interest, interpretation conspired with mental rehearsal to develop metamentation. Drawing on philosophical, psychological, and evolutionary perspectives, Bogdan analyzes the main phylogenetic and ontogenetic stages through which primates' abilities to interpret other minds evolve and gradually create the opportunities and resources for metamentation. Contrary to prevailing views, he concludes that metamentation benefits from, but is not a predetermined outcome of, logical abilities, language, and consciousness.
