A este fin, recurre a casos jurídicos tomados del derecho penal con la idea de mostrar que las discusiones jusfilosóficas acerca de la problemática de la interpretación tienen relevancia directa para el abogado penalista. Es un objetivo bastante ambicioso y me aprece un notable mérico de este libro el haberlo logrado. En este marco, propone a la interpretación de las normas como una actividad cognitiva compleja en la que cabe distinguir tres etapas: la identificación de las normas, su sisitematización y la determinación de su coherencia. Cada etapa involucra problemas de distinta índole, que deben ser enfrentados con metodologías diversas. El camino de la interepretación racional culmina cuando se arriba a una norma unívoca, consistente y coherente, norma expresada mediante un enunciado condiconal que correlaciona un caso genérico relevante con una consecuencia jurídica genérica. La invocación de una mayor racionalidad en la interpretación del derecho penal, en la armonización reflexiva de sus disposiciones, en el sometimiento de las conclusiones a reglas desarrolladas en el más estricto acatamiento a la lógica, no parece por cierto un mero ejercicio intelectual para iniciados, sino el fruto de una necesidad que hunde sus raíces en la defensa de la libertad y en el estatuto político emanado de la consituticón.

These theories significantly advance the case for coherentism in law. Nonetheless, there remain a number of problems in the coherence theory in law. This ambitious new work makes the first concerted attempt to develop a coherence-based theory of legal reasoning, and in so doing addresses, or at least mitigates these problems. The book is organized in three parts. The first part provides a critical analysis of the main coherentist approaches to both normative and factual reasoning in law. The second part investigates the coherence theory in a number of fields that are relevant to law: coherence theories of epistemic justification, coherentist approaches to belief revision and theory-choice in science, coherence theories of practical and moral reasoning and coherence-based approaches to discourse interpretation. Taking this interdisciplinary analysis as a starting point, the third part develops a coherence-based model of legal reasoning. While this model builds upon the standard theory of legal reasoning, it also leads to rethinking some of the basic assumptions that characterize this theory, and suggests some lines along which it may be further developed. Thus, ultimately, the book not only improves upon the current state of coherence theory in law, but also contributes to the larger debate about how to articulate a theory of legal reasoning that results in better decision-making.

Three-dimensionalism also appears in this work when one analyzes the “three” phases of the life of the law: The formation, the interpretation, and the application; and in the distinction between the “three” characteristics of the legal order: Fullness, coherence, and unity—the theory of legal validity, intended as legitimacy, as validity strictly speaking, or as effectiveness.
