Book Children s Environmental Rights Under International and EU Law

Download or read book Children s Environmental Rights Under International and EU Law written by Francesca Ippolito and published by Springer Nature. This book was released on 2022-11-07 with total page 346 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is dedicated to a topic which has for a long time lacked the attention it deserves within the academic world. It intends to address in a coherent and comprehensive manner the problem of the environmental rights of the child, which are not identical to the ones of adults whose environmental rights have been appraised from a general point of view. In the absence of any international law instrument explicitly granting a child the right to a clean environment, drawing on an extensive and original analysis of the UN Convention on the Rights of the Child and the practice of its monitoring body, this book undertakes an assessment of the extent to which these challenges may be overcome through a greater engagement between international law on the rights of the child and international environmental law. The result is the first comprehensive study on the manner in which these two mutually reinforcing legal regimes can interact to strengthen the protection of children’s environmental human rights at stake in the increased strategic environmental and climate litigations at both the national and international level. The book is recommended reading for, amongst others, policy makers, international environmental lawyers and human rights lawyers and practitioners. Additionally, lecturers, students and researchers from a range of disciplines will also gain from seeing how new legal scholarship and intertwined branches of international law contribute to the continual development of the living rights of the human rights conventions. Francesca Ippolito is Associate Professor of International Law in the Department of Political and Social Science of the University of Cagliari, Italy. She holds the Jean Monnet Chair on European Climate of Change - REACT for 2021-2024.

Book The Child and the European Convention on Human Rights

Download or read book The Child and the European Convention on Human Rights written by Ursula Kilkelly and published by Taylor & Francis. This book was released on 2024-11-01 with total page 358 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European Convention on Human Rights is the most successful system for the enforcement of human rights in the world. However, to date its full potential for protecting children’s rights has not been explored as attention has focused on the UN Convention on the Rights of the Child. This unique book provides the first analysis of the extensive case law of the Commission and the Court of Human Rights on all issues concerning children and their rights. This study is important as a study of the regional protection of children’s rights and, moreover, the case law itself can be directly applied in the legal system of nearly every European country, including the UK. The book includes chapters on the rights of the child under the European Convention on Human Rights in relation to education, protection from abuse, the right to identity, child care, juvenile justice, health care and immigration and the family. It also explores the potential of the Strasbourg mechanism for the protection of children’s rights and thus provides a practical and vital guide to the study and use of the European Convention in the broad area of children’s rights.

Book Human Rights in Developing Countries Yearbook 1994

Download or read book Human Rights in Developing Countries Yearbook 1994 written by Peter R. Baehr and published by BRILL. This book was released on 2024-01-15 with total page 452 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since 1985 seven Yearbooks have appeared containing articles on recent developments with regard to human rights in developing countries. Besides topical information on current issues and trends that pertain to these countries in general, the Yearbook describes the current situation in a selected group of developing countries. The Yearbook 1994 contains national reports on Angola, China, Ghana, Honduras, Pakistan, Sri Lanka and Tanzania. The authors and editors of the Yearbook use a broad definition of human rights meaning not merely civil and political rights but economic, social and cultural rights as well. This broad and modern perspective on the issue is reflected in the contents of the national reports and in the thematic studies in the first part of the book, covering a wide range of issues relevant to human rights in the developing world. Among the topics covered by the thematic studies this year are the Convention on the Rights of the Child, the influence of recognized human rights standards in the national politics of Eastern Europe, the social cost of adjustment and human rights protection and an evaluation of recent positive measures taken in the sphere of North-South cooperation. The Yearbook is an initiative of human rights institutes in Austria, Denmark, Norway, Sweden and the Netherlands with the purpose of reaching a wide audience interested in both human rights and development aid issues.

Available in PDF, EPUB and Kindle. Book excerpt: Recent years have seen an increased interest in the variety of cultures co-existing within one state, and a growing acknowledgement of the values ensconced in pluralistic social structures. this book examines the manner in which indigenous people can function in modern states, preserving their traditional customs, while simultaneously adapting aspects of their culture to the challenges posed by modern life. Whereas it was formerly assumed that these tribal frameworks were doomed to extinction, and some states even encouraged such a process, there has been a revival in their vitality, linked to a recognition of their rights. The book offers a comprehensive survey of various aspects of tribal life, focusing on political issues such as the meaning of sovereignty, legal issues dealing with the role of custom and social issues concerned with sustaining communal life. A focused study is made of a whole series of legal factors, relating to possession and ownership of land, religious rites, the nature of polygamous marriages, the assertion of group rites, the manner of peacefully resolving disputes and allied questions. Recent judicial decisions are analysed as a reflection of the far-reaching changes that have taken place, in a process that has seen the former disregard of basic rights of indigenous people being replaced by an awareness of the injustices perpetrated in the past and a willingness to seek to redress them. The comparison between approaches of different English-speaking countries provides an account of interwoven developments.

Book excerpt: Only available in paperback version ISBN 90 411 1091 7 This volume draws upon the author's own experience to highlight the complexities behind the global violations of children's rights. Analysis and description are interwoven to provide a coherent study of the international status of children and the rights which attach to this status, both for those familiar and unfamiliar with international law. The author demonstrates the potential of international law in protecting the rights of children, even in states which are restructuring their economies. To be effective, international law cannot be used in isolation and the text seeks to place the rights of the child in their cultural and historical contexts. All royalties from The International Law on the Rights of the Child are being donated to the International Save the Children Alliance to assist them in their work with children. 'Ms van Bueren combines skilfully an enormous amount of factual material with careful legal analysis and comment. [...] this book will rapidly become indispensable to children's rights lawyers...'
