Book excerpt: Excerpt from International Law Topics and Discussions The Navy Department, as has been the practice in recent years, assembled at the Naval War College on June 1, 1905, a conference of officers, a majority of whom were of high rank and long experience, to occupy four months in the discussion of the battle tactics and strategy of the fleet, and of those unsettled questions of international law which at times have seemed to threaten universal war. The topics considered in this volume are of vital interest, and it is desirable to make clear the manner in which the work was performed. They were formulated before the opening of the conference by the lecturer, Mr. George Grafton Wilson, professor in Brown University, in consultation with the president and staff of the War College. The officers were divided into committees when the conference assembled, and at stated intervals the committees submitted reports upon the several topics; the reports were then fully and freely discussed in a general conference participated in by the lecturer, the president and staff of the college, and all the officers in attendance. The conclusions published are those accepted in the general conference and may be fairly held to be without bias, since it is evident that in the future the United States may be affected either as neutral or as belligerent, and since the topics do not relate to questions pending. The field is wide and the time limited, but the work is justified, if besides increasing our knowledge it has contributed in any degree to the formulation of agreements tending to avert or ameliorate war. Except in so far as it deals with the theory of International Law it is necessarily a mere sketch, as my object was only to state a theory and to give an outline of its application. It has interested some of its few readers sufficiently to encourage me to publish it. I have not amplified it at all because I can see no value in any work occupying an intermediate position between an essay intended to excite interest in the subject and to indicate what might be done and an elaborate work on International Law such as I may hope to write some day but for which much time and labour would be required. At the same time I have revised the essay and made some alterations in it. Its nature and purpose are further explained in the introductory letter which was prefixed to it in its earlier form and which I here reprint. Wigmore, Dean of the Law School of Northwestern University, suggested to the author the preparation of a treatise reflecting what might be called the American conception of international law. That work was then begun. Out of it have grown the present volumes. They em body the results of a study of international law chiefly as it has been interpreted and applied by the United States. They express an attempt primarily to portray what the United States, through the agencies of its executive, legislative and judicial departments, has deemed to be the law of nations. It is not suggested that in legal contemplation there exists an American international law as distinct from that which meces sarily prevails throughout the society of civilized States. It is believed, however, that the views of the Department of State (embracing by implication those of the President), of the Con gress, and of the Courts of the United States, together with those of certain other governmental agencies, give expression to an authentic American understanding of what the principles of international law really are. Such an understanding is entitled to thorough examination and critical analysis; for it constitutes the only scientific basis for the formulation of principles in reliance upon which the United States, Whether at the Hague or elsewhere, may participate intelligently and worthily in the common effort to render the law of nations closely responsive to the just and changing demands of civilization. Clearness of thought concern ing rules which any State may soundly press for adoption in a codification designed for general approval imposes, as a condi tion precedent, an exact enunciation of what are conceived to be the, existing requirements of international law. The scope of the present work necessarily calls for the treat ment of numerous matters which, however closely associated with the international obligations of the United States, refer primarily to the domestic activities of an independent State in pursuance of its fundamental law. Book excerpt: Excerpt from Elements of International Law Mr. Wheaton, after receiving the ordinary preliminary in struction, graduated at the College of his native State, now Brown University, in 1802. During the ensuing three years he prepared himself, in the office of Nathaniel Searle, then among the prominent practitioners at Providence, for admission to the bar. His studies were, from his earliest days, of a cha reeter appropriate to the education of a publicist. Besides his proficiency in the classical and mathematical departments, he was particularly distinguished, at school and college, for his fondness for general literature, and especially for historical research and the investigation of the political annals of nations. In the spring of 1805, he went to Europe, and though his desire for intellectual improvement and his sound moral prin ciples would, probably, have proved an adequate protection against all improper temptations, it was, perhaps, well for his future success that his father's moderate views of expense did not permit him, at once, to luxuriate in a great metropolis. He established himself at Poitiers, where there was a school of law. His object seems to have been to acquire a familiarity with the use of the French language, in which he had been early instructed; while he availed himself of the Opportunity to frequent the tribunals and study the civil law. Indeed, in this branch of jurisprudence, Mr. Vvheaton might almost be deemed a pioneer among his countrymen. Even Pothier, whose works contributed so largely to the Napoleon Code, had not then been made accessible to the American lawyer. Nor had Kent and Story, whose decisions derive so much value from their abundant stores of continental lore, and both of whom had repeated occasion to appreciate the early studies of Mr. Wheaton, then assumed their places in the tribunals, which they subsequently illustrated - the one as Chancellor of New York, the other as a member of the Supreme Federal Judi Clary.
