Book excerpt: The Darfur crisis has left behind a profound legacy of displacement, with some 300,000 refugees camped on the Chadian side of the border and about 2 million displaced internally within Darfur. Despite a reduction in armed hostilities and violent casualties since 2006, as well as a peace agreement signed at Doha in 2011, limited signs of voluntary repatriation are visible from eastern Chad; where refugees are seemingly willing, but not ready, to return. Further to the Doha peace settlement, they require genuine peace to be in place on the ground, marked by visible changes in the security landscape of Sudan. In particular, they ask for the prosecution of war criminals, disarmament of local militias, adequate compensation for human and physical losses, local reconstruction, and the departure of populations who have settled on their lands in the aftermath of mass atrocities. The marked demographic changes having taken place in Darfur over the past decade, and a ‘peace’ that fails to fully address impunity and be widely accepted, make the fulfillment of these requests seem far-fetched at present. While voluntary return is being discussed nationally and regionally, refugees underscore their profound need for justice and personal safety by remaining in the camps. When and how conditions for safe and dignified return will be met is something they are still carefully considering.

Building on field research in the autumn and winter of 2015 , it analyses the patterns of return and coping strategies of returnees, as well as any assistance that aid agencies can provide. The findings indicate that return is neither a simple, linear nor necessarily durable solution. From the viewpoint of the returnees, the main challenges of return are the lack of physical security, food, water, education and jobs. As resources in South Sudan are very scarce overall because of a collapsing economy and continued fighting, competition over resources between returnees and local communities, as well among returnees, is common. The easy access to small arms, ethnic divisions and mistrust between groups further exacerbate these tensions. The sustainability of return seems to depend largely on how well returnees can access resources at their return location

However, although over nine million refugees were repatriated worldwide between 1991 and 1995, there are reasons to believe that it will not necessarily be a durable solution for refugees. The changing constructions and realities of refugee repatriation provide the backdrop for this book which presents new empirical research on examples of refugee repatriation and reconstruction. Book excerpt: The objectives of this report are to assess the role that relocation and repatriation can play in the context of the Government of Sudan's overall strategy for rehabilitating Sudan's displaced persons, and to evaluate relocation and rehabilitation programmes currently being implemented or planned. The report begins with a brief description of the dimensions of the problem. The author, a consultant to the United Nations Development Programme Emergency Office in Khartoum, then places Sudan's policies on relocation and repatriation in the context of longer-term experiences and responses to displaced populations. Special attention is given to 79 recommendations produced by the National Conference of the Displaced. A separate section of the report details basic needs and concerns of potential donors towards relocation and/or repatriation programmes. The major part of the report deals with an assessment of responses and programmes. It examines an array of structured and unstructured responses and comments on their viability and contribution to longer-term rehabilitation and reconstruction objectives. The focus is mainly on two principal strategies: the relocation of Khartoum displacees to the periphery of the metropolitan area and within the Khartoum region. Mention is also made of organized resettlement and relocation schemes in Darfur, Kordofan and Upper Nile and spontaneous repatriation and relocation. Several recommendations appear at the end of the report.

More than half of the population of Syria remains displaced; 5.6 million persons are registered as refugees outside of the country and another 6.2 million are displaced within Syria's borders. The internally displaced persons include 2 million school-age children; of these, less than half attend school. Another 739,000 Syrian children are out of school in the five neighborhood countries that host Syria's refugees. The loss of human capital is staggering, and it will create permanent hardships for generations of Syrians going forward. Despite the tragic prospects for renewed fighting in certain parts of the country, an overall reduction in armed conflict is possible going forward. However, international experience shows that the absence of fighting is rarely a singular trigger for the return of displaced people. Numerous other factors—including improved security and socioeconomic conditions in origin states, access to property and assets, the availability of key services, and restitution in home areas—play important roles in shaping the scale and composition of the returns. Overall, refugees have their own calculus of return that considers all of these factors and assesses available options. The Mobility of Displaced Syrians: An Economic and Social Analysis sheds light on the 'mobility calculus' of Syrian refugees. While dismissing any policies that imply wrongful practices involving forced repatriation, the study analyzes factors that may be considered by refugees in their own decisions to relocate. It provides a conceptual framework, supported by data and analysis, to facilitate an impartial conversation about refugees and their mobility choices. It also explores the diversified policy toolkit that the international community has available—and the most effective ways in which the toolkit can be adapted—to maximize the well-being of refugees, host countries, and the people in Syria.

The goal of a just return process must be to recast a new relationship of rights and duties between the state and its returning citizens, and the conditions of just return match the core duties states should provide for all their citizens: equal, effective protection for security and basic human rights, including accountability for violations of these rights. This volume evaluates the ways in which different forms of redress such as restitution and compensation may help enable just returns, and traces the emergence and evolution of international norms on redress for refugees.
