Book excerpt: The study reported in this document was designed to contribute to on-going work on policy harmonization and on the environmental protection provisions of the Agreement on Internal Trade. It first discusses ways of defining internal trade barriers, including impacts-based and principles-based definitions such as those contained in trade agreements. It develops a framework to help identify the trade impacts of environmental protection measures and to determine if the measures constitute internal trade barriers. Such measures include emission standards, product and packaging standards, eco-labelling, professional licensing, product charges, government procurement policies, and subsidies. The framework is then applied to 17 generic environmental protection measures including command-and-control regulations and economic instruments. The framework is also applied to existing measures that have been identified as internal trade barriers. Finally, the impacts of environmental measures on internal trade are evaluated.

Estimates suggest that complete liberalization of internal trade in goods can increase GDP per capita by about 4 percent and reallocate employment towards provinces that experience large productivity gains from trade. The positive impact highlights the need for federal, provincial and territorial governments to work together to reduce internal trade barriers. There is significant scope to build on the new Canadian Free Trade Agreement to more explicitly identify key trade restrictions, resolve differences, and agree on cooperative solutions.

But trade between the provinces is harder than with foreign countries. We trouble our own house with an amazing variety of barriers: professionals and tradespeople cannot move freely and practice where they wish, regulation makes it hard for investments to flow to where they are most needed, provincial governments give contracts to local firms even though out-of-province firms can do the job at a lower cost, Ottawa pays the most generous UI to regions with the highest unemployment and thereby encourages people to stay in parts of the country with little promise. The effects of such barriers on the economy are difficult to measure, which may be the reason that little has been done about them. But Canadians cannot afford to ignore their costs. The European Community is very close to the goal of ensuring free trade among its members. Unless we unlock our potential we may fall behind other countries and communities that have recognized the importance of internal as well as external free trade.

Both deals have achieved their aims. Trade Barriers to the Public Good provides a detailed examination of NAFTA and AIT cases involving MMT - a chemical additive brought into Canada by the US company Ethyl Corporation Inc. When the Canadian federal government banned the importation of MMT under the Fuel Additives Act, Ethyl Corp. filed a claim under NAFTA Chapter 11 seeking US $201 million in damages. Alex Michalos uses a case study of MMT to reveal exactly how and why quasi-judicial international dispute processes provide significantly less protection for the public interest than the routine procedures for passing an ordinary Act of Parliament. Trade Barriers to the Public Good illustrates why and how constitutionally protected democratic rights are undermined by trade deals such as the one involving MMT and, failing termination of NAFTA and AIT - the author's first choice for remedial action - recommends precise changes in dispute settlement rules that are needed to protect individuals and the environment.

This shift enabled an unprecedented economic convergence: poor countries grew rapidly and began to catch up with richer countries. Since the 2008 global financial crisis, however, the growth of trade has been sluggish and the expansion of GVCs has stalled. Meanwhile, serious threats have emerged to the model of trade-led growth. New technologies could draw production closer to the consumer and reduce the demand for labor. And trade conflicts among large countries could lead to a retrenchment or a segmentation of GVCs. World Development Report 2020: Trading for Development in the Age of Global Value Chains examines whether there is still a path to development through GVCs and trade. It concludes that technological change is, at this stage, more a boon than a curse. GVCs can continue to boost growth, create better jobs, and reduce poverty provided that developing countries implement deeper reforms to promote GVC participation; industrial countries pursue open, predictable policies; and all countries revive multilateral cooperation.

This report, the summary volume, includes the history of residential schools, the legacy of that school system, and the full text of the Commission's 94 recommendations for action to address that legacy. This report lays bare a part of Canada's history that until recently was little-known to most non-Aboriginal Canadians. The Commission discusses the logic of the colonization of Canada's territories, and why and how policy and practice developed to end the existence of distinct societies of Aboriginal peoples. Using brief excerpts from the powerful testimony heard from Survivors, this report documents the residential school system which forced children into institutions where they were forbidden to speak their language, required to discard their clothing in favour of institutional wear, given inadequate food, housed in inferior and fire-prone buildings, required to work when they should have been studying, and subjected to emotional, psychological and often physical abuse. In this setting, cruel punishments were all too common, as was sexual abuse. More than 30,000 Survivors have been compensated financially by the Government of Canada for their experiences in residential schools, but the legacy of this experience is ongoing today. This report explains the links to high rates of Aboriginal children being taken from their families, abuse of drugs and alcohol, and high rates of suicide. The report documents the drastic decline in the presence of Aboriginal languages, even as Survivors and others work to maintain their distinctive cultures, traditions, and governance. The report offers 94 calls to action on the part of governments, churches, public institutions and non-Aboriginal Canadians as a path to meaningful reconciliation of Canada today with Aboriginal citizens. Even though the historical experience of residential schools constituted an act of cultural genocide by Canadian government authorities, the United Nation's declaration of the rights of aboriginal peoples and the specific recommendations of the Commission offer a path to move from apology for these events to true reconciliation that can be embraced by all Canadians.
