The familiar Socratic conceit from the Phaedrus, of communication as the process of writing directly on the soul of the other, has returned to center stage in today's discussions of culture and media. Indeed Western thought has long construed media as a grand choice between two kinds of interfaces. Following the optimistic path, media seamlessly interface self and other in a transparent and immediate connection. But, following the pessimistic path, media are the obstacles to direct communion, disintegrating self and other into misunderstanding and contradiction. In other words, media interfaces are either clear or complicated, either beautiful or deceptive, either already known or endlessly interpretable. Recognizing the limits of either path, Galloway charts an alternative course by considering the interface as an autonomous zone of aesthetic activity, guided by its own logic and its own ends: the interface effect. Rather than praising user-friendly interfaces that work well, or castigating those that work poorly, this book considers the unworkable nature of all interfaces, from windows and doors to screens and keyboards. Considered allegorically, such thresholds do not so much tell the story of their own operations but beckon outward into the realm of social and political life, and in so doing ask a question to which the political interpretation of interfaces is the only coherent answer. Grounded in philosophy and cultural theory and driven by close readings of video games, software, television, painting, and other images, Galloway seeks to explain the logic of digital culture through an analysis of its most emblematic and ubiquitous manifestation – the interface.

Often, this lofty role has been characterised by a narrow and dogmatic scientific training, an unwillingness to communicate to differing stakeholder needs, a refusal to accept and to manage uncertainty, complexity and value commitments, and the reduction of knowledge assessment to colleague peer review on narrowly technical issues. Times have changed. As the world faces increasingly disparate challenges, science is subjected to increasingly vehement demands from a society calling for transparency, openness and public participation in science policy. Science is going through an evolutionary process. Perhaps the most painful process it has ever encountered. Research on the interfaces between science and society is a burgeoning area. A new conception of knowledge now appears to be emerging, based on the awareness of complexity, uncertainty and a plurality of legitimate perspectives and interests. Democracy is extending into the previously quite exclusive scientific realm, and science must now submit to public scrutiny and participation in the governance of knowledge. This book provides much-needed reflections on the methods and tools for knowledge quality assurance, particularly on its inputs to extended policy and decision-making processes. The overall aim is to improve the relationship between science and society. The discussion involves six themes: communicating between plural perspectives; accepting and learning how to manage uncertainty, complexity and value commitments; acknowledging new conceptions of knowledge; implementing transparency, openness and participation in science policy; valuing community-based research; and exploring how new ICT can support inclusive governance. Taken together, these themes provide both a framework and vision on how to conceive, discuss and evaluate the changes that are occurring. The chapters cover theory, practice, approaches, experiences, ideas and suggestions for a move beyond "talking the talk" to "walking the walk". Science and policy interfaces are dynamic processes needing to permanently redefine themselves and their roles. This book contributes to the enrichment and deepening of our understanding of these important new trends in the social relations of science, which are fundamental to our understanding of the prospects for further progress. It suggests that orthodox sociology and sociology of education have not sufficiently analysed contemporary educational situations due primarily to the strength of the economic and educational influence of neoliberalism. In drawing upon key aspects of the work of Dewey, Freire, Bernstein and Bourdieu, a new reflexive sociology of knowledge is proposed that could potentially revolutionise public schooling and emancipate learning. This critical reconceptualisation of curriculum and teaching, as well as the democratic inclusion of all children into structures of privileged and community knowledge, opens up a new epistemological stage in the sociology of education worldwide. In confronting the contradiction between social marginalisation and educational expectations, Learning at the Practice Interface explores new approaches to education systems and knowledge production. Part A raises questions regarding knowledge, pedagogy and social justice that are central to schooling and which support values weakened by neoliberalism. These values include democracy, equity, community collaboration and deference towards knowledge and culture not dependent on wealth and status. Part B explores practical issues related to how knowledge is engaged in the school curriculum. This discussion goes to the heart of learning at the practice interface and suggests that the lack of epistemological strategies based on sociological description has created serious estrangement from school knowledge for large numbers of students. Part C discusses a critical view of knowledge in relation to research, teaching and learning and the education profession generally. The need for a new reflexive sociology of knowledge is proposed to guide educational dialogue and action such that connections can be made between progressive sociology and epistemology in the interests of all children. Book excerpt: The Copyright/Trademark Interface How the Expansion of Trademark Protection Is Stifling Cultural Creativity Martin Senftleben The registration of cultural icons as trademarks has become a standard protection strategy in the field of contemporary cultural productions and plays an ever-increasing role in the area of cultural heritage. Attempts to register and ‘evergreen’ the protection of cultural signs, ranging from ‘Mickey Mouse’ to the ‘Mona Lisa’, are no longer unusual. This phenomenon – characterized by the EFTA Court as trademark registrations motivated by ‘commercial greed’ – has become typical of an era where trademark law is employed strategically to withhold or remove cultural symbols from the public domain. In an extraordinary analysis of the clash between culture and commerce, and imbalances caused by protection overlaps arising from cumulative copyright and trademark protection, this book draws attention to the corrosive effect of indefinitely renewable trademark rights and underscores the necessity to safeguard central preconditions for the proper functioning of the copyright system in society at large: the freedom to use pre-existing works as reference points for the artistic discourse and building blocks for new creations, and the need to ensure the constant enrichment of the public domain. Emphasizing how overlapping copyright and trademark protection endangers the proper functioning of intellectual property rights in the literary and artistic domain, the author examines whether the intellectual property system is capable of mitigating the risks arising from cumulative protection. Such issues and topics as the following are treated in depth: the different configuration of intellectual property rights in accordance with different policy objectives and societal functions, in particular the cultural imperative in copyright law and the market transparency imperative in trademark law; problems arising from the registration of cultural icons for use on souvenir and merchandising articles; lack of sufficient safeguards in trademark law against cultural heritage branding; current scope of trademark rights, including the protection of brand value and communication functions, and the deterrent effect of trademark protection on cultural creativity; possibility of a categorical exclusion of contemporary cultural icons and cultural heritage material from trademark protection; development of a strict gatekeeper requirement of ‘use as a mark’ to prevent unjustified trademark infringement claims; development of robust, culturally based defences against trademark infringement claims; and general guidelines for the regulation of protection overlaps in intellectual property law, based on insights derived from the analysis of copyright/trademark overlaps. Drawing on aesthetic, sociological and economic theories that support initiatives to safeguard the autonomy of the literary and artistic domain and support remix activities of artists, the author suggests sound criteria for identifying signs with cultural significance that should be excluded from trademark registration. The book shows how intellectual property law can make rights cumulation strategies less attractive and avoid the loss of inner consistency and social legitimacy, easing the tension between indefinitely renewable trademark rights and the need to preserve and cultivate the public domain of cultural expressions and other intellectual creations that enjoy protection for a limited period of time, such as industrial designs and technical know-how. Its assessment criteria will assist and enable trademark examiners and judges to identify relevant cultural signs, and its proposals for regulatory responses to protection overlaps in intellectual property law will prove of great and lasting value to lawyers, policymakers, and scholars dealing with intellectual property law.
