La teneur de l'interdiction posée par ces deux dispositions est la même, seule change l'étendue de leur domaine d'application respectif : alors que l'article 14 interdit la discrimination dans « la jouissance des droits et libertés reconnus dans la présente Convention », l'article 1er du Protocole n° 12 interdit la discrimination de manière plus large dans « la jouissance de tout droit prévu par la loi ».
