Book The Intellectual Property Regulatory Complex

Download or read book The Intellectual Property Regulatory Complex written by Emily Marden and published by UBC Press. This book was released on 2016-03-06 with total page 273 pages. Available in PDF, EPUB and Kindle. Book excerpt: Advances in agricultural genomics could help address pressing global issues, such as world hunger, by improving crop yield. However, overlap and conflict in intellectual property and biosafety regimes – known collectively as the “Intellectual Property–Regulatory Complex” – create significant barriers to innovation. In this collection, leading legal, policy, and economics experts analyze the impact of the Complex on agricultural genomics. They reveal how it impacts scientific advancement in ways that are underappreciated when intellectual property and biosafety regimes are examined in isolation. After identifying how the interplay between multiple regimes impedes research, development, and product distribution, they propose solutions that would further the aims of the current intellectual property and biosafety regimes while enabling growth and innovation in agricultural genomics.

Book Agricultural Biotechnology and Intellectual Property

Download or read book Agricultural Biotechnology and Intellectual Property written by Jay P. Kesan and published by CABI. This book was released on 2007-01-01 with total page 413 pages. Available in PDF, EPUB and Kindle. Book excerpt: Scientists are becoming progressively more involved in developing methods for increasing agricultural productivity and designing plants with certain qualities. As such, genetic engineering has given plant breeders a means to exercise property rights over different varieties of plants. This has created many implications and given way to much controversy, with most objections being raised against the idea of owning life. With the use of comparative studies, this book discusses the legal, agribusiness and public policy issues that connect intellectual property protection with advancements in agricultural biotechnology.

This book was released on 2009 with total page 475 pages. Available in PDF, EPUB and Kindle. Book excerpt: . . . recommended to anyone interested in the thrilling subject of the relationship of IPRs and innovation. Ralf Uhrich, Journal of Intellectual Property This is an outstanding piece of scholarship. It will serve as a powerful stimulant for new research in the field and as a reliable guide for practitioners. Calestous Juma, Harvard University, US Intellectual property rights (IPRs), particularly patents, occupy a prominent position in innovation systems, but to what extent they support or hinder innovation is widely disputed. Through the lens of biotechnology, this book delves deeply into the main issues at the crossroads of innovation and IPRs to evaluate claims of the positive and negative impacts of IPRs on innovation. An international group of scholars from a range of disciplines economic geography, health law, business, philosophy, history, public health, management examine how IPRs actually operate in innovation systems, not just from the perspective of theory but grounded in their global, regional, national, current and historical contexts. In so doing, the contributors seek to uncover and move beyond deeply held assumptions about the role of IPRs in innovation systems. Scholars and students interested in innovation, science and technology policy, intellectual property rights and technology transfer will find this volume of great interest. The findings will also be of value to decision makers in science and technology policy and managers of intellectual property in biotechnology and venture capital firms.

Book Intellectual Property Rights in Agricultural Biotechnology and Access to Technology

Download or read book Intellectual Property Rights in Agricultural Biotechnology and Access to Technology written by Kshitij K. Singh and published by . This book was released on 2017 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: IP protection to agricultural biotechnology has remained a contentious issue in India having serious implications for stakeholders and agricultural innovation. Farmers and plant breeders made strong resistance against the extension of IP monopoly to agriculture sector and were sceptical that their rights could be compromised against the interest of giant agro-based companies. However, the growing need to enhance food production, improve the quality of seeds, experiment the nutritional content of food crops and attract investment in agricultural field necessitated the conjunction of IPR and agricultural biotechnology. India has adopted a dual form of IP protection for agricultural biotechnology; plant varieties are protected through the Protection of Plant Variety and Farmers' Rights Act 2001, while the genetic traits of plants are protected through the Patents Act 1970. Though the line of demarcation as to the application of both the laws is theoretically drawn, enormous confusion persists on practical level. The IP protection to agricultural biotechnology has not produced desired results in India due to asymmetrical innovation model, complex regulatory structure and confusing regulatory approach. The exclusive licensing practices with exorbitant licensing fee on uneven licensing terms place licensor, licensee and end user in a conflicting position and raise the issues of accessibility and affordability of technology.
