Download or read book Contract Law in Brazil written by Lisiane Feiten Wingert Ody and published by Kluwer Law International B.V.. This book was released on 2021-05-20 with total page 230 pages. Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this practical analysis of the law of contracts in Brazil covers every aspect of the subject-definition and classification of contracts, contractual liability, relation to the law of property, good faith, burden of proof, defects, penalty clauses, arbitration clauses, remedies in case of non-performance, damages, power of attorney, and much more. Lawyers who handle transnational contracts will appreciate the explanation of fundamental differences in terminology, application, and procedure from one legal system to another, as well as the international aspects of contract law. Throughout the book, the treatment emphasizes drafting considerations. An introduction in which contracts are defined and contrasted to torts, quasi-contracts, and property is followed by a discussion of the concepts of ‘consideration’ or ‘cause’ and other underlying principles of the formation of contract. Subsequent chapters cover the doctrines of ‘relative effect’, termination of contract, and remedies for non-performance. The second part of the book, recognizing the need to categorize an agreement as a specific contract in order to determine the rules which apply to it, describes the nature of agency, sale, lease, building contracts, and other types of contract. Facts are presented in such a way that readers who are unfamiliar with specific terms and concepts in varying contexts will fully grasp their meaning and significance. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable time-saving tool for business and legal professionals alike. Lawyers representing parties with interests in Brazil will welcome this very useful guide, and academics and researchers will appreciate its value in the study of comparative contract law

Download or read book Free Soil in the Atlantic World written by Sue Peabody and published by Routledge. This book was released on 2016-04-14 with total page 211 pages. Available in PDF, EPUB and Kindle. Book excerpt: Free Soil in the Atlantic World examines the principle that slaves who crossed particular territorial frontiers- from European medieval cities to the Atlantic nation states of the nineteenth century- achieved their freedom. Based upon legislation and judicial cases, each essay considers the legal origins of Free Soil and the context in which it was invoked: medieval England, Toulouse and medieval France, early modern France and the Mediterranean, the Netherlands, eighteenth-century Portugal, nineteenth-century Angola, nineteenth-century Spain and Cuba, and the Brazilian-Paraguay borderlands. On the one hand, Free Soil policies were deployed by weaker polities to attract worker-settlers; however, by the eighteenth century, Free Soil was increasingly invoked by European imperial centres to distinguish colonial regimes based in slavery from the privileges and liberties associated with the metropole. This book was originally published as a special issue of Slavery and Abolition.

Download or read book Political Thought in Portugal and its Empire c 1500 1800 Volume 1 written by Pedro Cardim and published by Cambridge University Press. This book was released on 2021-10-21 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: Showcasing texts by Portuguese and Luso-Brazilian authors, this volume demonstrates the wealth of the political thought of early modern Portugal and its empire. Gathering together important texts on social order, government, and politics by authors who made a significant contribution to the development of early modern Portugal, it demonstrates that Portugal was the setting for vibrant political debate, often shaped by, and emerging in response to, very particular assumptions, circumstances, and concerns. Combining a chronological approach with in-depth thematic sections, the book explores how some controversies that took place in Portugal centred on themes similar to those in other European countries, while others were linked to the specific nature and history of the Portuguese monarchy and its interactions with other polities. It thus offers an overview of the main debates on politics and government and contributes to a more nuanced understanding of the multifaceted history of European political ideas.

Download or read book Goals of Civil Justice and Civil Procedure in Contemporary Judicial Systems written by Alan Uzelac and published by Springer Science & Business Media. This book was released on 2014-01-11 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a collection of papers that address a fundamental question: What is the role of civil justice and civil procedure in the various national traditions in the contemporary world? The book presents striking differences among a range of countries and legal traditions, but also points to common trends and open issues. It brings together prominent experts, professionals and scholars from both civil and common law jurisdictions. It represents all main legal traditions ranging from Europe (Germanic and Romanic countries, Scandinavia, ex-Socialist countries) and Russia to the Americas (North and South) and China (Mainland and Hong Kong). While addressing the main issue – the goals of civil justice – the book discusses the most topical concerns regarding the functioning and efficiency of national systems of civil justice. These include concerns such as finding the appropriate balance between accurate fact-finding and the right to a fair trial within a reasonable time, the processing of hard cases and the function of civil justice as a specific public service. In the mosaic of contrasts and oppositions special place is devoted to the continuing battle between the individualistic/liberal approach and the collectivist/paternalistic approach – the battle in which, seemingly, paternalistic tendencies regain momentum in a number of contemporary justice systems.
Download or read book U S Power and the Social State in Brazil written by Júlio Cattai and published by Routledge. This book was released on 2021-12-29 with total page 219 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book analyzes the elite-led efforts to transform the Brazilian legal order in the period between 1930–1975 and how U.S. Power played a major role in such a process. Besides the global circulation of ideas, the book discusses the Brazilian institutional development in the period. A profound "Crisis of Civilization" marked the first decades of the century: the references of space and time vanished with the vertiginous expansion of cities and industries, while a myriad of immigrants and former slaves were alleged to be threatening the country’s traditions. Brazilian elites blamed liberalism for such a "Crisis". Based on a decade of research, this book centralizes Brazilian history in liberalism and offers a genealogy of the jurisprudential and institutional struggles to correct the culture of laissez-faire. Using archival sources, it shows the direct U.S. influence on Brazilian thought and development. Recasting the history of legal ideas in the 20th century and providing novel interpretations on major political processes, it offers a rigorous and fresh look at the development of liberalism in the country. Covering five decades of history and offering a transnational approach involving the U.S. hegemonic role in Brazil, this book will be of interest to scholars and students of law, U.S. foreign policy, area studies and international relations.

Download or read book Slave Subjectivities in the Iberian Worlds written by and published by BRILL. This book was released on 2023-12-18 with total page 340 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Iberian world played a key role in the global trade of enslaved people from the 15th century onwards. Scholars of Iberian forms of slavery face challenges accessing the subjectivity of the enslaved, given the scarcity of autobiographical sources. This book offers a compelling example of innovative methodologies that draw on alternative archives and documents, such as inquisitorial and trial records, to examine enslaved individuals' and collective subjectivities under Iberian political dominion. It explores themes such as race, gender, labour, social mobility and emancipation, religion, and politics, shedding light on the lived experiences of those enslaved in the Iberian world from the Indian Ocean to the Atlantic.
