Available in PDF, EPUB and Kindle. Book excerpt: Are the cognitive sciences relevant for law? How do they influence legal theory and practice? Should lawyers become part-time cognitive scientists? The recent advances in the cognitive sciences have reshaped our conceptions of human decision-making and behavior. Many claim, for instance, that we can no longer view ourselves as purely rational agents equipped with free will. This change is vitally important for lawyers, who are forced to rethink the foundations of their theories and the framework of legal practice. Featuring multidisciplinary scholars from around the world, this book offers a comprehensive overview of the emerging field of law and the cognitive sciences. It develops new theories and provides often provocative insights into the relationship between the cognitive sciences and various dimensions of the law including legal philosophy and methodology, doctrinal issues, and evidence.

Book Strengthening Forensic Science in the United States

Download or read book Strengthening Forensic Science in the United States written by National Research Council and published by National Academies Press. This book was released on 2009-07-29 with total page 348 pages. Available in PDF, EPUB and Kindle. Book excerpt: Scores of talented and dedicated people serve the forensic science community, performing vitally important work. However, they are often constrained by lack of adequate resources, sound policies, and national support. It is clear that change and advancements, both systematic and scientific, are needed in a number of forensic science disciplines to ensure the reliability of work, establish enforceable standards, and promote best practices with consistent application. Strengthening Forensic Science in the United States: A Path Forward provides a detailed plan for addressing these needs and suggests the creation of a new government entity, the National Institute of Forensic Science, to establish and enforce standards within the forensic science community. The benefits of improving and regulating the forensic science disciplines are clear: assisting law enforcement officials, enhancing homeland security, and reducing the risk of wrongful conviction and exoneration. Strengthening Forensic Science in the United States gives a full account of what is needed to advance the forensic science disciplines, including upgrading of systems and organizational structures, better training, widespread adoption of uniform and enforceable best practices, and mandatory certification and accreditation programs. While this book provides an essential call-to-action for congress and policy makers, it also serves as a vital tool for law enforcement agencies, criminal prosecutors and attorneys, and forensic science educators.

Download or read book Insanity written by Charles Patrick Ewing and published by Oxford University Press. This book was released on 2008-04-07 with total page 215 pages. Available in PDF, EPUB and Kindle. Book excerpt: The insanity defense is one of the oldest fixtures of the Anglo-American legal tradition. Though it is available to people charged with virtually any crime, and is often employed without controversy, homicide defendants who raise the insanity defense are often viewed by the public and even the legal system as trying to get away with murder. Often it seems that legal result of an insanity defense is unpredictable, and is determined not by the defendants mental state, but by their lawyers and psychologists influence. From the thousands of murder cases in which defendants have claimed insanity, Doctor Ewing has chosen ten of the most influential and widely varied. Some were successful in their insanity plea, while others were rejected. Some of the defendants remain household names years after the fact, like Jack Ruby, while others were never nationally publicized. Regardless of the circumstances, each case considered here was extremely controversial, hotly contested, and relied heavily on lengthy testimony by expert psychologists and psychiatrists. Several of them played a major role in shaping the criminal justice system as we know it today. In this book, Ewing skillfully conveys the psychological and legal drama of each case, while providing important and fresh professional insights. For the legal or psychological professional, as well as the interested reader, Insanity will take you into the minds of some of the most incomprehensible murderers of our age.

Book Legal Insanity Explorations in Psychiatry Law and Ethics

Download or read book Legal Insanity Explorations in Psychiatry Law and Ethics written by Gerben Meynen and published by Springer. This book was released on 2016-11-08 with total page 203 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines core issues related to legal insanity, integrating perspectives from psychiatry, law, and ethics. Various criteria for insanity are analyzed and recommendations for forensic psychiatric and legal practice are offered. Many legal systems have an insanity defense, in one form or another. Still, it remains unclear exactly when and why mental disorders affect a person’s moral or criminal responsibility. Questions addressed in this book include: Why should insanity be a component of our legal system? What should be the criteria for an insanity defense? What would be the reasons for abolishing it? Who should bear the burden of proof? Furthermore, the book discusses the impact neurosciences may have on psychiatric and psychological evaluations of defendants as well as on legal decisions about insanity.

Aidan Collins has his very first large case when his client, Marina Vasiliev, a drop-dead gorgeous mental patient, is accused of killing her wealthy husband. Marina insists that she didn't do it, but Aidan can't trust her. He knows Marina well, too well. After all, he met Marina in the mental hospital - he originally obtained her as a client when she was involuntarily committed, and he assisted her with getting out. Diagnosed with borderline personality disorder, Marina's view of reality shifts from day to day. Moment to moment. Wracked with paranoia, suicidal behavior and mental instability, Marina also admits that she has losses of time - entire days where she has no idea what happened. Marina has no memory of what happened the night that her husband died. Aidan can never be sure if Marina is guilty or not. He makes the decision that the best way to defend her would be to try for the insanity defense. His client is not on board with this decision, and, to make things worse, she begins to imagine him as her lover, which turns his professional relationship with her upside down. It also puts Aidan into danger, both professionally and personally. However, once Aidan gets more into the case, he begins to doubt that his decision to try for the insanity defense was a sound one. Clues lead away from Marina's involvement in her husband's murder. Before long, Aidan feels that his reality is shifting as much as his client. One day, he's convinced that she's guilty. The next, he's convinced that somebody else did it. Aidan can never be sure that he's doing the right thing in using the insanity defense. An 11th hour witness throws his entire trial strategy into disarray. With the lightning pace, twists and turns that you've come to expect from a Rachel Sinclair novel, By Reason of Insanity is a legal thriller that is not to be missed.

Book Black Rage Confronts the Law

Download or read book Black Rage Confronts the Law written by Paul Harris and published by NYU Press. This book was released on 1997-05-01 with total page 309 pages. Available in PDF, EPUB and Kindle. Book excerpt: Traces the origins of the black rage defense in criminal court history In 1971, Paul Harris pioneered the modern version of the black rage defense when he successfully defended a young black man charged with armed bank robbery. Dubbed one of the most novel criminal defenses in American history by Vanity Fair, the black rage defense is enormously controversial, frequently dismissed as irresponsible, nothing less than a harbinger of anarchy. Consider the firestorm of protest that resulted when the defense for Colin Ferguson, the gunman who murdered numerous passengers on a New York commuter train, claimed it was considering a black rage defense. In this thought-provoking book, Harris traces the origins of the black rage defense back through American history, recreating numerous dramatic trials along the way. For example, he recounts in vivid detail how Clarence Darrow, defense attorney in the famous Scopes Monkey trial, first introduced the notion of an environmental hardship defense in 1925 while defending a black family who shot into a drunken white mob that had encircled their home. Emphasizing that the black rage defense must be enlisted responsibly and selectively, Harris skillfully distinguishes between applying an environmental defense and simply blaming society, in the abstract, for individual crimes. If Ferguson had invoked such a defense, in Harris's words, it would have sent a superficial, wrong-headed, blame-everything-on-racism message. Careful not to succumb to easy generalizations, Harris also addresses the possibilities of a white rage defense and the more recent phenomenon of cultural defenses. He illustrates how a person's environment can, and does, affect his or her life and actions, how even the most rational person can become criminally deranged, when bludgeoned into hopelessness by exploitation, racism, and relentless poverty.

Dershowitz, Esq., Felix Frankfurter Professor, HarvardLaw: " Reversal of Fortune has been subject to many analyses over the years. This one is the best I have seen for law students and a legal audience. It really gets to the heart of the legal, tactical, and ethical issues in the case. It would be extremely useful for law students who view the film to read this perceptive and insightful analysis." Jon S. Oxman, Esq., "The analysis of Silkwood brings into focus the complex linkages among labor law, workers' compensation rights, and federal and state statutory protections such as OSHA and whistleblower acts. ... Watching Silkwood with the author's insights in mind will deepen the significance of both the movie and the law school experience." Patricia E. Weidler, Esq., "I wish I had this book when going through law school. It's perfect for those times when a student needs to step back from studying legal concepts and yet wishes to learn from a different angle. Attorney Buck's book allows a student to take a couple of hours off and yet apply critical thinking skills, analyze the issues, and critique Hollywood's views on the law. ... Reading this book ... will encourage lawyers, law school students, and armchair lawyers alike to look at real cases, which sometimes are even stranger than the movies!"
