Book excerpt: Over 6.5 million youth and their families are eligible for early intervention or special education services (Data Accountability Center, 2011) under the Individuals with Disabilities Education Act of 2004 (IDEA). The principal mechanism by which goals, objectives, services, and placements are determined for Part B of the IDEA are Individualized Education Program (IEP) meetings. Programs for children birth to three who receive services under Part C are developed in Individualized Family Service Plan (IFSP) meetings. Each plan or program is developed by a team of parents, early childhood service providers, teachers, administrators, and related service providers, as well as attorneys and advocates. These meetings represent an important opportunity to draw on participants' expertise and aspirations in the interest of developing a plan that leads to important learning outcomes for the child. Making important decisions and developing plans on one's own is often difficult. Making important decisions with others--particularly those who hold differing views--is further complicated. Fortunately, many groups find that the challenges of aligning diverse viewpoints can be overcome with the support of a facilitator--a term grounded in the Latin word for "easy". An effective facilitator makes a group's work easier by supporting clear communication among prepared parties in a structured and focused process. The application of facilitation to IEP/IFSP meetings has significantly increased. In 2008, twenty-four states reported using IEP facilitation, and another eight states were in the planning or development stages. As the practice of IEP/IFSP facilitation has grown, a body of expertise and associated practice recommendations has emerged. This document summarizes practical insights and promising practices for IEP/IFSP facilitation, collected from a broad review of facilitation and special education literature.

Book excerpt: Individual Education Program (IEP) teams are composed of diverse individuals, each bringing a unique set of experiences, knowledge, and skills to the table. Given this, it is not uncommon for team members to have different views on the special education and related services needs of the student whose plan is being developed. When divergent views between families and local educational agency (LEA) staff cause deadlock in the IEP process, the Individuals with Disabilities Education Act (IDEA) makes available a continuum of dispute resolution options. These options range from collaborative approaches, e.g., mediation, to more adversarial ones, such as written State complaints and due process hearing requests. These processes focus primarily on anticipated dissension across the table between families and educators. IDEA does not address instances when the child's parents are disputing with each other. What happens when tensions between the child's parents undermine the IEP process? The purpose of this publication is twofold: (1) to assist the reader in better understanding the problem; and (2) to highlight both preventative and responsive strategies for IEP teams when parents or caregivers are having difficulty working together. Children's best interests are served when all members of the IEP team cooperate to design the IEP. Properly prepared and appropriately skilled IEP team members--administrators, educators, related service providers, the student, and parents alike--can improve the dynamics and interactions among team members in service of this goal. The information, strategies, and approaches presented herein were drawn from a variety of sources, including research on the effects of parenting a child with a disability on parent and family relationships, literature on conflict resolution practices, and data collected through surveys and interviews with a cross-section of IDEA stakeholders from around the United States. Many of the victims are “Mislabeled as Disabled.” Denied proper instruction, they fall behind in regular general education, overwhelm teachers, and hold back classmates. Out of desperation, school systems unlawfully “dump” such "Mislabeled as Disabled" students in special education, even though they do not have a true medical disability.
