GAO has long reported that DOD’s procurement processes are vulnerable to waste, fraud, and abuse. In 2018, DOD reported to Congress that from fiscal years 2013- 2017, over $6.6 billion had been recovered from defense-contracting fraud cases. In 2020, the DOD Office of Inspector General reported that roughly one-in-five of its ongoing investigations are related to procurement fraud. This report assesses the steps DOD took in fiscal year 2020 (1) to combat department- wide fraud risks and (2) to conduct a fraud risk assessment and ensure that DOD’s component organizations reported procurement fraud risks. GAO makes five recommendations, including that DOD fill all Task Force positions, update its policy to require fraud risk assessments, and ensure that components assess procurement fraud risks.

While the emphasis of the handbook is toward contract auditors, the information may prove useful for all auditors. The 1988 revision to the Government Auditing Standards, issued by the Comptroller General of the United States, requires tests for compliance with applicable laws and regulations. The auditing standards require the auditor to design steps and procedures that provide a reasonable assurance of detecting errors, irregularities and illegal ads that could materially affect the financial related audits. The 1988 revision also significantly increased the auditor's responsibility, from remaining alert for fraud indicators to designing steps to reasonably assure detecting irregularities and illegal ads.

Book excerpt: This report on contractor fraud was prepared by the Department of Defense at the direction of Congress. Congress directed the assessment to include the total value of DOD contracts entered into with contractors indicted for, settled charges of, been fined by the government for, or been convicted of fraud in connection with past transactions involving DOD or its components. Because there is no central repository for this data, DOD faced a number of challenges in developing this report. First and foremost was the development a common definition of 'procurement fraud.' Fraud is a broad category and DOD components were found to classify it differently. Additionally, it was discovered that the manner in which the data are reported differs. DOD's chief finding was that financial obligations to contractors convicted of fraud continued, in some cases, after their conviction.

Among other things, the agreement required E-Systems to report all hotline allegations to the Army's Procurement Fraud Division. When the Subcommittee on Oversight and Investigations, House Committee on Energy and Commerce, received allegations from a former chief investigator for E-Systems' Greenville (Texas) Division concerning the division's hotline/ethics program, the Subcommittee's then Chairman, asked the General Accounting Office (GAO) to answer the following questions: (1) Did federal law, regulations, or the Memcor Agreement require E-Systems to disclose suspected violations of procurement law?; (2) How many and what types of hotline complaints were lodged against E-Systems' Greenville Division?; (3) Did E-Systems' employees, contrary to federal law, alter or reinvestigate hotline complaints and investigation results to avoid disclosing information to the federal government; and what were the details behind three cases that had been brought to the Subcommittee's attention?; (4) Why did the Army not debar E-Systems from doing business with the government, given the serious accusations contained in a May 1994 Army 'show cause' letter?; and (5) What loss did the government experience as a result of E-Systems' actions in the three previously mentioned hotline cases?
