Conservation easements are a common tool for range conservation, but the perpetual nature of their individually negotiated rights and restrictions may present a challenge for adaptive land management. The evolution of conservation easement approaches to land management was addressed in a review of 52 grazing easements created by The Nature Conservancy (TNC) in California rangelands between 1973 and 2006 as well as through interviews with TNC staff. Easement terms related to land management increased in complexity over time, particularly for purchased easements on private land. Easements commonly contained restrictions on riparian or wetland management (58%), residual dry matter (50%), and type of animal permitted (46%) but rarely restricted number of cattle or animal unit months (4%). Flexibility was provided by easement terms such as exceptions for drought years and reference to best management practices, the easement holder's administrative discretion, and easement amendment. Interviews with TNC staff revealed an iterative process in which conservation easements remain relatively fixed once they are established, whereas subsequent easements incorporate lessons learned from easement monitoring, enforcement, management, and applicable science. Conservation easements with an adaptive approach would link compliance terms with conservation goals, require monitoring of those terms, and have a mechanism for altering land management based on monitoring results. All three of these realms present challenges for the conservation easement structure. Improvements could be made in easement terms, ecological monitoring, and stewardship to improve the effectiveness and adaptability of this tool for maintaining ecological function on working ranches.

Book excerpt: The acquisition of conservation easements by nonprofit organizations (“NPOs”) over the past twenty-five years has revolutionized the preservation of American land. Recently, however, legislatures, courts, practitioners, and commentators have debated whether and how conservation easements should be modified and even terminated. The discussion has almost always been on a theoretical level without empirical grounding and has sometimes generated much heat but little light. The discussion has lacked the necessary empirical context to allow legislatures and courts to thoughtfully develop resolutions to these issues free from sloganeering and posturing. This article provides and analyzes a previously uncollected dataset that offers guidance on the appropriate rules of law for conservation easement modification. It examines policy goals in light of the data to suggest various modification rules that would be more effective than current practice. The dataset represents a significant sample of easement modifications that have been made during a six year period (2008-2013) and indicates several findings: first, modifications have actually been taking place, despite claims that conservation easements are “perpetual,” apparently indicating that NPOs need flexibility in at least some areas; most of the changes have been “minor” and have been either conservation neutral or conservation positive, though one would expect pressure for more significant alterations over time due to shifts in the environment and human needs; there is a range of types and degree of modifications to this point, suggesting that there should be a spectrum of procedural and substantive requirements for the different varieties of modifications; and, a mandate for a stand-alone, state registry of conservation easements and modifications would allow for improved policymaking. The article suggests that a doctrine that requires different procedures and substantive rules for various categories of modifications -- a sliding scale -- may yield the best, policy-based results. The work also identifies and analyzes existing doctrines -- federal tax law, specific state statutes, charitable trust doctrine, standing rules, and director liability -- that would need to be altered or clarified to adopt effective modification rules.

Book excerpt: The essence of a conservation easement as a static perpetual restriction is coming to a head with the understanding that the world is a changing place. This demonstration is nowhere more dramatic than in the context of global climate change. In response to this conflict, users of conservation easements face the decision of either (1) changing conservation easement agreements to fit the landscape or (2) changing the landscape to fit the conservation easements. Both of these options present benefits and challenges in implementation. Where conservation easement holders' ultimate goal is to keep a maximum number of acres under protection from development, flexible conservation easements may present a viable and attractive method of protection. Where a specific conservation value or habitat is the concern, active management of the land may be more appropriate. As a further complication, both of these options are at odds with the essential nature of conservation easements. These conflicts lead to a third option: making different decisions about where and how to use conservation easements. This would likely lead to the conclusion that conservation easements are only desirable in a narrower category of purposes. This is, of course, dismaying to champions of conservation easements. Unfortunately, ensuring the long-term viability of conservation easements may entail omitting the very features that give conservation easements their strength.

Available in PDF, EPUB and Kindle. Book excerpt: The use of conservation easements has been increasing in the United States. However, patterns of growth over time are different for individual states. Little is known on how determinants of conservation easements interact with one another and affect the choice of conservation approaches. The study objective was to analyze conservation easement trends and examine underlying choice determinants in the United States. Panel data models were employed to assess determinants of easement acres and contracts from 1995 to 2015. Findings revealed that the northern United States has the most percentage of land area under conservation easements. The growth in conservation easements was positively related to gross state products, land market values, air quality, and land use, while it was negatively related to state population density, conservation spending, easement duration and endangered species. Public policymakers would use these findings to integrate easement efforts into local planning to meet conservation and land-use objectives.
