Book excerpt: Registrars of voters in the State of Louisiana and private citizens of Louisiana brought suits against members of the Civil Rights Commission to enjoin commission from holding its anticipated hearing, and in the suit by the registrars of voters it was contended that the Civil Rights Act is unconstitutional, and a 3 judge court was convened. ... The Supreme Court, Mr. Chief Justice Warren, held that the commission was authorized by the Civil Rights Act of 1957 to adopt rules of procedure providing that identity of persons submitting complaints to commission need not be disclosed, and that those summoned to testify before commission, including persons against whom complaints have been filed, may not cross-examine other witnesses called by commission, and that rules of procedure do not violate rights of persons against whom complaints have been filed under due process clause of the 5th Amendment to the Federal Constitution. Reversed and remanded.
