The Buenos Aires water and sanitation concession led to remarkable improvements in delivery and coverage of services and to lower prices for consumers. But a poor information base, lack of transparency in regulatory decisions, and the ad hoc nature of executive branch interventions make it difficult to reassure consumers that their welfare is being protected and that the concession is sustainable.The signing of a concession contract for the Buenos Aires water and sanitation system in December 1992 attracted worldwide attention and caused considerable controversy in Argentina. It was one of the world's largest concessions, but the case was also interesting for other reasons. The concession was implemented rapidly, in contrast with slow implementation of privatization in Santiago, for example. And reform generated major improvements in the sector, including wider coverage, better service, more efficient company operations, and reduced waste. Moreover, the winning bid brought an immediate 26.9 percent reduction in water system tariffs.Consumers benefited from the system's expansion and from the immediate drop in real prices, which was only partly reversed by subsequent changes in tariffs and access charges. And these improvements would probably not have occurred under public administration of the system. Still, as Alcazar, Abdala, and Shirley show, information asymmetries, perverse incentives, and weak regulatory institutions could threaten the concession's sustainability. Opportunities for the company to act opportunistically - and the regulator, arbitrarily - exist because of politicized regulation, a poor information base, serious flaws in the concession contract, a lumpy and ad hoc tariff system, and a general lack of transparency in the regulatory process. Because of these circumstances, public confidence in the process has eroded. The Buenos Aires concession shows how important transparent, rule-based decisionmaking is to maintaining public trust in regulated infrastructure.This paper - a product of Regulation and Competition Policy, Development Research Group - is part of a larger effort in the group to analyze institutional issues in regulated infrastructure. The return of cholera in 1991 to the Latin America and Caribbean region was only a symptom of the deep-seated problems and the fragility and inadequacy of publicly operated water supply and sanitation systems. Consequently, the agencies that operate these systems are entering a crucial phase of deciding whether they can greatly improve their operations while remaining in the public sector or whether they should seek increasing private sector financing and participation in both operations. This study consists of two chapters. The first analyzes the main problems of the public sector, explains the rationale behind private sector participation, and reviews an array of options for such participation. The second chapter highlights a case study of the Buenos Aires Concession--a large concession for the Greater Buenos Aires water supply and sewerage services awarded by the national government to a private consortium of foreign operators and local investors. The case study is an excellent example of how attention to the planning and contracting stages can ensure a successful transition from public to private management.

This concept is also employed in piped water provision. The failure of some major projects suggests that there is considerable risk involved when the public and private sectors combine forces. The fact that piped water provision is a natural monopoly and therefore needs extensive regulation makes the cooperation between the public and private sector very difficult. Indeed, weak regulation is the probably the most important risk factor. Other risk factors include political instability, inadequate tariff and contract design, and lack of public support. These risk factors are analyzed using four case studies, two failed ones and two that are considered relatively successful. The analysis aims to find answers to the question whether the initiative of development agencies to heavily promote the concept of public-private partnerships in water and sanitation is justified and appropriate. Einleitung: Public-private partnerships werden im verstärkten Maße von Institutionen für Entwicklungshilfe eingesetzt, um die Infrastruktur in Entwicklungsländern zu verbessern. Dieses Konzept wird unter anderem auch in der Wasserversorgung verwendet. Das Fehlschlagen von einigen wichtigen Projekten weist darauf hin, dass ein gewisses Risiko existiert, wenn der öffentliche Sektor und die Privatwirtschaft zusammen arbeiten. Der Fakt, dass Wasserversorgung ein natürliches Monopol ist und daher besonders starke Regulierung braucht, erschwert die Kooperation zwischen öffentlichen Sektor und Privatwirtschaft. Ungenügende Regulierung ist möglicherweise der wichtigste Risikofaktor. Andere Risikofaktoren sind politische Instabilität, ein schlecht gestaltetes Gebührensystem, ein ungenauer Vertrag und fehlende Unterstützung der Bevölkerung und der Regierung. Diese Faktoren werden mit Hilfe von vier Fallbespielen analysiert, zwei gescheiterten und zwei, die als relativ erfolgreich betrachtet werden. Book excerpt: Water utilities are the main instrument for countries to achieve universal service coverage. In pursuing universal service coverage, water utilities have turned to pro-poor water services to extend water services in low-income areas. This thesis discusses the use of pro-poor water services by water utilities in Kenya, with the intention of highlighting the dimensions of the approach that require attention of policy makers and practitioners when engaging with the concept. Based on the analysis of the technologies, financial and organisational arrangements associated with the pro-poor concept, this thesis shows that the use of pro-poor strategies allows water utilities to reduce the risks of servicing low-income areas while still claiming to fulfil their mandate of providing access to all in a commercially viable manner. The analysis also shows that rather than a decision of the water utility, the choice for pro-poor strategies emerges as the result of a consensus or compromise between the different actors that constitute the broader institutional environment in which water utilities operate. The thesis concludes that while pro-poor water services may serve the interests of water utilities and other stakeholders, in the absence of well-directed subsidies and proper monitoring they will not result in low-income households benefiting from more affordable and reliable access to water.
