Book excerpt: Abstract: The purpose of this study was to analyze the Adoption and Safe Families Act's (ASFA) impact of defined timelines on parents, foster/adoption system and children. This study evaluated both overt and covert objectives of the time frames set by ASFA. Since the implementation of ASFA, findings have found that more children in foster care have achieved permanency through adoption. There is a quick turnaround of termination of parental rights due to set time frames for reunification. ASFA's goal of permanency by limiting time frames of reunification has created difficulties for parents to reunify with their children; in turn, most children who are not adopted are left to linger in the foster care system. Differences in circumstances of each family and children in foster care should be considered when implementing time frames. These families often need time to resolve the issues that brought them into the child welfare system.

Available in PDF, EPUB and Kindle. Book excerpt: Abstract: The purpose of this study was to perform a comprehensive analysis of the Adoption and Safe Families Act (ASFA) of 1997. ASFA aimed to promote permanency for children in the foster care system through the utilization of adoption. By promoting adoption, ASFA hoped to lower the number of children in the foster care system and shorten the length of their stay. A review of academic literature is presented in order to provide an historical context for ASFA's implementation within the child welfare system, and David Gil's framework is utilized in the analysis of ASFA. The outcome of this study reveals that the number of completed adoptions has increased. However, the number of children awaiting adoption continues to be higher than the number of completed adoptions, and children continue to spend long periods of time in out-of-home care. In addition, ASFA has had unintended consequences on parties involved in the child welfare system, particularly families of color.

A review of the scholarly literature is provided to place ASFA within the historical context of foster care and the child welfare system. The results of this study indicate that while the number of adoptions have increased, so have the number of children waiting to be adopted and who continue to linger in care. ASFA has also created unintended consequences for children and families of color and who are in poverty. Limitations to the study as well as implications for social work policy and practice are discussed.

ASFA's goal was to decrease the number of children in foster care and the long lengths of stay children were spending in foster care by promoting permanency via adoption for those children who are unable to reunify with their parents. A modified version of David Gil's model and methodology for social policy analysis was utilized to analyze this legislation. The results of this study revealed that while the number of adoptions increased following the enactment of ASFA, the number of children waiting to be adopted also increased. On average, children who have been legally freed for adoption spend 23.6 months in foster care, waiting to be adopted. ASFA has failed to take into account the underlying issues that many families face, such as mental health, substance abuse, and poverty issues, and their impact on the parents' ability to reunify with their children within the set time frames. Intended and unintended consequences, as well as implications for social work policy and practice, are discussed.

In passing ASFA, Congress emphasized two primary themes. First, Congress made clear that the paramount goal for public child welfare systems is to secure the health and safety of the children who enter these systems. Second, Congress recommitted public child welfare systems to the goal of securing timely permanent placement outcomes for children. An appreciation of ASFA's historical context is necessary to gain an understanding of its actual goals and its consistent design. Consideration of the historical context is also necessary in order to assess the likelihood of ASFA's success. As became apparent under Adoption Assistance and Child Welfare Act of 1980 (AACWA), the breach can be quite wide between legislative design and actual implementation in the trenches of public child welfare systems. Because of the need to consider ASFA's historical context, Part II of this article assesses the implementation of AACWA. Part III examines ASFA in light of the AACWA experience and assesses the likelihood of, and the role of legal professionals in, the effective implementation of ASFA. Part IV considers the possibility of additional congressional action.
